I have attached the MOU from 2018 for your review, as well as an email below regarding the project. From the email, it appears that City staff may have been confused as to what was in the MOU, as the document did specify the lane configuration, and does speak to the construction of the project as well, not just the design. Given all the public input into issues such as the Black & Olive building and the creation of Parking benefit Districts, it appears that this project was afforded very little public input. I hope that the City will take a moment to review this decision, and allow for public input before this project that will cost a minimum of $15 million is allowed to proceed. Thank you for your time and attention to this matter. Finally, I want to emphasize that I am not representing Montana State University on this issue, and that MSU (President Cruzado) may have a different opinion than mine. BACKGROUND: The City of Bozeman receives an annual allocation of approximately $1Million per year which may be used to construct or reconstruct streets which are part of the Urban Routes Network. The last project so funded was West College Street between South 19th Avenue and Main Street. Upon completion of that project the Bozeman City Commission, on the recommendation of the Bozeman Master Transportation Plan, Transportation Coordinating Committee and City staff, identified improvements to West Kagy Boulevard between Willson Avenue and South 19th Avenue as the next project to be constructed using those funds. A series of public meetings was held with stakeholders (Montana State University, Bozeman Health, Museum of the Rockies) and the public to outline the scope and nature of the improvements desired by the community for this important roadway. After months of consideration a recommended design was approved by both the stakeholders and the city commission. The total estimated cost of the project as approved is $15,051,500.00. Our current Urban Fund balance is approximately $4,300,000.00, and the city has committed the use of $3,000,000.00 in impact fees to the project, leaving us roughly $7.7M short of having the necessary funding. 109 MDT also has a policy which allows urban areas to borrow up to 5 years against their annual allocation. Taking all of these factors into account, it will be at least Fiscal Year 2022 before we will have enough funding to build this project. In order for MDT to continue funding of the engineering design in the interim, it is necessary that the City and MDT enter into the attached agreement. The agreement summarizes the roles of the City and MDT through both the design and construction phases of the project. The agreement has been exhaustively reviewed by the legal department as well as by the Engineering Division. The responsibilities detailed are identical with activities we are already performing, hence we are recommending entering into this agreement. UNRESOLVED ISSUES: None. FISCAL EFFECTS: The background section describes the general funding plan for this project. Ultimately all of the funding to be used, as currently understood, will be coming from the City, either through its annual urban allocation or from impact fees. Page 4 of the agreement itself also summarizes the breakdown of costs. ALTERNATIVES: As suggested by the City Commission.
