MEETING DATE: November 10, 2020 RECOMMENDATION: Approve and authorize the City Manager to sign amendment No. 3
to the professional services agreement for the 2018-2021 Materials Testing Contract with
Morrison-Maierle, Inc. for the purpose of obtaining materials testing on various City projects for the remainder of the construction season. BACKGROUND: In 2014 the City began retaining a consultant to provide construction
materials testing on all our construction projects. We are currently in our 3rd year of a 3-year
term contract with Morrison-Maierle, Inc. to provide materials testing services. We have reached our cost not to exceed amount of $100,000 for this construction season, and therefore, a contract amendment is required to continue retaining materials testing services for the remainder of the year. The initial cost not to exceed amount was based on our estimated materials testing
needs. During the construction season, additional City projects and construction work was added
beyond our initial scope. This amendment will add work to our existing contract. Engineering staff have reviewed the amendment and found it to be commensurate with the work involved. Attached are three copies of the partially executed amendment with Morrison-Maierle, Inc. for
2018-2021 Materials Testing professional services.

UNRESOLVED ISSUES: None ALTERNATIVES: As suggested by the commission
FISCAL EFFECTS: As described in Attachment “Amendment to Standard Agreement for Professional Services” to the Professional Services Agreement, materials testing services will be billed by a combination of unit
costs and hourly rates depending on the test being performed with
a cost not to exceed limit of $65,000. The testing will be paid for with approved funding from each associated project which receives testing under this agreement.

Attachment A-2Scope of Services2018-2020 Materials TestingMaterial testing is to be performed in compliance with the City of Bozeman's Design Standardsand Specification Policy for soils, aggregates, concrete, and asphalt.
