Section 2 – RECOMMENDED CONDITIONS OF APPROVAL
Please note that these conditions are in addition to any required code provisions identified in this report.
These conditions are specific to the development.
Section 3 – REQUIRED CODE CORRECTIONS All citations are to the Bozeman Municipal Code (BMC).

ENGINEERING COMMENTS:
Paybacks
1. The subject property is located within the North 19th and Baxter Intersection payback district boundary
for traffic signal improvements. The subject property did not participate in the original cost of
construction of improvements and will be accessed a payback charge prior to site plan approval. Please
contact Katherine Maines (kmaines@bozeman.net) to determine the associated payback fee.
Response: It is our understanding that the owner has contacted Katherine and that the
payback district charge has been paid.
Stormwater
1. DSSP Section II. Drainage Policy – A stormwater drainage plan is required for all new developments.
a. Markups to the Revised July 2020 Timber Ridge Apartments Stormwater Design report are
attached and must be addressed prior to site plan approval.
Response: The Stormwater Report has been revised, addressing the markups that were
provided. The updated stormwater report is included herein.
Water Rights
1. BMC 38.410.130 (A) (1) Water rights - The applicant must contact Brian Heaston with the City
Engineering Department to obtain a determination of cash-in-lieu of water rights (CILWR). CILWR must
be paid prior to site plan approval.
a. The applicant has provided CILWR estimate; however, there is no documentation of
coordination with Brain Heaston and the CILWR amount has not been paid.
Response: It is our understanding that the owner has contacted Brian Heaston and that the
CILWR has been paid.
Recommended Conditions of Approval
1. If they do not already exist the applicant must provide and file with the County Clerk and Recorder's office
executed Waivers of Right to Protest Creation of Special Improvement Districts (SID’s) for the following:

a) Street improvements to North 27th Ave from Baxter Lane to West Oak Street including lighting,
signalization, paving, curb/gutter, sidewalk, and storm drainage.
b) Street improvements to Baxter Lane from Davis Lane to North 19th Ave including lighting, signalization,
paving, curb/gutter, sidewalk, and storm drainage.
c) Intersection improvements for Tschache Lane to North 27th Ave.
d) Intersection improvements for Baxter Lane and North 27th Ave.
The applicant may obtain a copy of the template SID waiver from the City Engineering Department (Lance
Lehigh). The document filed must specify that in the event an SID is not utilized for the completion of
these improvements, the applicant agrees to participate in an alternate financing method for the
completion of said improvements on a fair share, proportionate basis as determined by square footage of
property, taxable valuation of the property, traffic contribution from the development, or a combination
thereof. The applicant must provide a copy of the SID waiver filed with the County Clerk and Recorder
prior to site plan approval.
The document needs to be updated per the recommended conditions of approval.
Response: It is our understanding that the owner has contacted the City regarding the Waivers
and that the signed Waiver has been provided to the city.
ENGINEERING ADVISORY COMMENTS:
1. The applicant is advised that fire service plans must be a standalone submittal, separate from the site plan
submittal. The applicant must prepare plans and specifications for any fire service line in accordance with
the City’s Fire Service Line Policy. The plans must be prepared by a Professional Engineer and be provided
to and approved by the City Engineer prior to initiation of construction of the fire service or fire protection
system. The applicant must also provide Professional Engineering services for construction inspection,
post-construction certification and preparation of mylar record drawings. Fire service plans, and domestic
services 4” or larger, must be a standalone submittal, separate from the site plan submittal. City of
Bozeman applications for service must be completed by the applicant.
Response: Condition Acknowledged. The fire service line plans will be prepared and submitted
separately to the City Engineering Department. The applicant will retain engineering services
for inspection, certification, and record drawings.
Future Impact Fees - Please note that future building permit applications will require payment of the required
transportation, water, sewer and fire impact fees according to the City of Bozeman adopted impact fee
schedule in place at the time of building permit issuance. If you desire an estimate of the required impact
fees according to current rates please contact the Department of Community Development and/or visit.

Note: During preparation of the staff report, additional conditions of approval may be recommended
based on comments and recommendations provided by other applicable review agencies involved
with the review of the project.
These divisions did not provide comments, contact reviewers directly with questions.
