MINUTES OF THE MEETING OF THE CITY COMMISSION
BOZEMAN,MONTANA
November 3, 2004

The Commission of the Cityof Bozeman met in special session in the Commission Room, Municipal
Building, on Wednesday, November 3, 2004, at 4:30 p.m. Present were Mayor Andrew Cetraro,
Commissioner Jeff Krauss, Commissioner Marcia Youngman, Commissioner Steve Kirchhoff,
Commissioner Lee Hietala, Acting City Attorney Tim Cooper and Clerk of the Commission Robin Sullivan.
Signing of Notice of Special Meeting
Each of the Commissioners, in turn, signed the Notice of Special Meeting.
Public comment
No comment was received under this agenda item.
Executive Session re Personnel
At 4:30 p.m., Mayor Cetraro announced that, pursuant to Section 2-3-203(3), M.C.A., the Montana
Constitution and the Montana Supreme Court rulings, he, as presiding officer, has determined that the right
to privacy clearly exceeds the merits of public disclosure. He then called an executive session for the
purpose of reviewing the applications and results of the interviews and subsequent research.
At 4:40 p.m., Mayor Cetraro closed the executive session and reconvened the open meeting.
Appointment of Municipal Judge
It was moved by Commissioner Youngman, seconded by Commissioner Kirchhoff, that Kayle
Jackson be appointed to replace Patricia Kyle Carlson as the Municipal Judge. The motion failed by the
following Aye and No vote: those voting Aye being Commissioner Youngman and Commissioner Kirchhoff;
those voting No being Commissioner Hietala, Commissioner Krauss and Mayor Cetraro.
Commissioner Youngman stated that Kayle Jackson was her first choice, but she found both
candidates were very good and would serve the community effectively and fairly. In light of the previous
motion, she is willing to support the appointment of Karl Seel, noting she anticipates he will bring a good
professional quality to the office that will be effective for justice.
Commissioner Krauss stated he felt both were great candidates. One of the things he liked about
Kayle Jackson was his broad base of experience. He was, however, concerned about Mr. Jackson's
response on whether he intended to run for election while Mr. Seel was positive in his response to that
question. He then indicated that he will support the appointment of Karl Seel.
Mayor Cetraro indicated his concurrence with the comments of the two Commissioners, stating he
supports the appointment of Karl Seel as Municipal Judge.
It was moved by Commissioner Hietala, seconded by Commissioner Krauss, that Karl Seel be
appointed to replace Patricia Kyle Carlson as the Municipal Judge. The motion carried by the following Aye
and No vote: those voting Aye being Commissioner Hietala, Commissioner Krauss, Commissioner
Youngman, Commissioner Kirchhoff and Mayor Cetraro; those voting No, none.

Discussion. FYI Items
(1 ) Commissioner Kirchhoff announced that he came straight from a Garage at City Center
meeting to this meeting. He noted that the Board and the Parking Commission were viewing a new plan
for the parking structure that does not bridge North Black Avenue, but is housed entirely on the block
between North Tracy Avenue and North Black Avenue. He indicated that, since the groundwater is 21 feet
below grade, the new structure includes one level below grade and four above grade, providing the 400+
parking spaces required in the memorandum of agreement. He stated the new plan provides for a simple
garage, similar to the initial proposal, with retail spaces on the ground level; and the cost estimate is very
close to the amount budgeted. He then announced that this new plan will hopefully be unveiled to the
Commission within the next few weeks.
Adiournment . 4:50 p.m.
There being no further business to come before the Commission at this time, it was moved by
Commissioner Kirchhoff, seconded by Commissioner Hietala, that the meeting be adjourned. The motion
carried by the following Aye and No vote: those voting Aye being Commissioner Kirchhoff, Commissioner
Hietala, Commissioner Krauss, Commissioner Youngman and yor Cetraro; those voting No, none.
