Olive Street Bozeman, MT 59718 RE: Response to DRC Comments – Jennifer Place Condominiums Site Plan & MSP Applications (#19153 & #19154) Dear Ms. Rosenberg: This letter is to provide a narrative response to the DRC comments from August 5, 2019. All responses are shown in bold: Recommended Conditions of Approval Please note that these conditions are in addition to any required code provisions identified in this report. These conditions are specific to the development. 1. The applicant is advised that unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. • The applicant acknowledges this condition. 2. The Recorded Land Use Notice form will be required to be signed, recorded, and returned prior to building permit submittal. (Will be provided upon Director Determination with the staff report) • The applicant acknowledges this condition. 3. All easements need to be recorded prior to Site Plan approval. • All easements have been provided. Executed copies of the easements are included in this resubmittal. 4. Cash-In-Lieu of Water Rights needs to be paid prior to Site Plan approval. • The CIL of Water Rights credit for the subject property was sufficient to cover the Civil/Structural Engineering and Surveying proposed demand of the project. Please see the correspondence with City Engineer Brian Heaston included in the site plan application. 5. The SID waiver needs to be recorded prior to Site Plan approval. • A copy of the executed SID waiver is included in this submittal. Submit a full set of drawings (2 large format and 1 11x17) with revisions clouded. Include a table of contents will all drawings and their date of creation/revision. Ensure that the electronic version includes a fully updated, complete application. • A full set of drawings (2 large format and 1 11x17) and a full digital version of the application is included with this resubmittal along with the RC form. 2. The applicant must submit a construction phasing plan including access and routes to ensure no conflicts with residents and emergency vehicle access and required turnarounds during construction of subsequent phases. Show the staging areas and all proposed fencing for subsequent phases. If Phases 7-10 will not be constructed in a Site Plan, show those phases as well. • A construction phasing plan has been included with this submittal. 2. Call out the new sewer main manhole on Annie Street on Sheet C2.0. • The new sewer manhole has been called out on C2.0. 3. BMC Section 38.270.030.C. An Irrevocable Offer of Dedication needs to be submitted with the Concurrent Construction application. A DEQ approval letter must also be submitted. • A copy of the executed Irrevocable Offer of Dedication has been included with this submittal. 4. The utility vacation will require associated documentation (Release and Reconveyance) to be submitted. • A Release and Reconveyance is included with this submittal. Additionally, correspondence with Northwestern is included showing their compliance with
