RELEASE AND RECONVEYANCE OF EASEMENT
COMES NOW the City of Bozeman, 121 N. Rouse Avenue, Bozeman, MT 59715, a
Municipal Corporation of the State of Montana,the GRANTOR,does hereby release and reconvey
the following described easement unto Great Western Investments,LLC, with a mailing address of
15525 Horse Creek Road, Bozeman, MT 59715,the GRANTEE, as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a public utility easement situated
along the south line of Lot 1, Block 9, Laurel Glen Subdivision,Phase 1, City of Bozeman, [Plat J-
374], Gallatin County, Montana.
WHEREAS the above public utility easement was granted by the filing of the plat of Laurel
Glen Subdivision, Phase 1, [Plat J-374], on January 22, 2004 as Document Number 2138460,
records of the office of the Clerk and Recorder, Gallatin County, Montana.
WHEREAS the installation of utility infrastructure has been completed without having to
occupy the portion of said easement that lies along the south boundary of said Lot 1, Block 9, as
shown and dimensioned on the attached Exhibit A, which by this reference is made a part of this
document. The termination of said portion of the 12 foot wide public utility easement will not
adversely impact the Grantor's interests.
WHEREFORE,the Grantor does hereby release and reconvey to Great Western Investments,
LLC, the portion of the 12 foot wide public utility easement as shown and dimensioned on the
attached Exhibit A as being terminated, together with any right, title, or interest that the Grantor
may have in said public utility easement. The remaining public utility easements located along the
perimeter of said Lot 1, Block 9, shall remain intact.
