RE: Response to DRC Comments – Jennifer Place Condominiums Site Plan & MSP
Applications (#19153 & #19154)
Dear Ms. Rosenberg:
This letter is to provide a narrative response to the DRC comments from July 8, 2019. All responses
are shown in bold:
Recommended Conditions of Approval
Please note that these conditions are in addition to any required code provisions identified in this
report. These conditions are specific to the development.
1. The applicant is advised that unmet code provisions, or code provisions that are not specifically
listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the
lawful requirements of the Bozeman Municipal Code or state law.
• The applicant acknowledges this condition.
2. The Recorded Land Use Notice form will be required to be signed, recorded, and returned prior
to building permit submittal. (Will be provided upon Director Determination with the staff
report)
• The applicant acknowledges this condition.
3. All easements need to be recorded prior to Site Plan approval.
• All easements have been provided. Executed copies of the easements are included in
this resubmittal.
4. The SID waiver needs to be recorded prior to Site Plan approval.

• A copy of the recorded SID waiver is included in this submittal. The document
number is 2691639.

1. All easements need to be recorded prior to Site Plan approval.
• The necessary documents have been executed by the owner. The documents will need
to go to the consent agenda to be filed.
2. Call out the new sewer main manhole on Annie Street on Sheet C2.0.
• The new sewer manhole has been called out on C2.0 for the Master Site Plan and
Phase 1.
3. The Public Utility Easement must be a minimum of 30 feet wide. The 10 foot private utility
easement on the sidewalk side of the drive access can be removed to accommodate the public
utility easement width. Update on Sheet C2.0 as well. The infrastructure plans and sheet C2.0
still shows 25’. Sheet C1.0 show a 30’ easement but it overlaps with the 10’ private utility
easements.
• The Public Utility easement is now shown as 30 feet wide. The adjacent private utility
easement has been removed and the utilities will run in the existing easement along
the property boundary.
4. The removal of the 10 foot easement to accommodate a 30’ public Utility easement on the
south side needs to be coordinated with NWE.
• The utility location has been coordinated with Cammy at NEW. The utilities will run
in the existing 12’ utility easement around the property. A portion of the easement
will be released and reconvayed per the submitted document.
5. On the easement, the names of the signatures of the city clerk and city manager need to be
adjusted. The City Manager is Jeff Mihelich and the City Clerk is Mike Maas.
• The documents have been updated with the appropriate names and dates.

1. The dollar amount needs to change to $1.60. Update cover sheet to reflect changes.
• The cover sheet has been updated to include the attached CIL Parkland memo.
2. CIL must be paid for prior to site plan approval.
