Lantern Park Master Plan Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Addi Jadin, Parks Planner and Development Manager Mitch Overton, Director of Parks and Recreation Chuck Winn, Assistant City Manager SUBJECT: Lantern Park Master Plan MEETING DATE: October 13, 2020 AGENDA ITEM TYPE: Action RECOMMENDATION: Staff and the Recreation and Parks Advisory Board Subdivision Review Committee recommend approval of the Lantern Park Master Plan RECOMMENDED MOTION: Having reviewed and considered all application materials, staff report and presentation, and public comment, I hereby move to approve the Lantern Park Master Plan associated with the Graf Street Apartments Master Site Plan Application 19309 and the Nexus Point Master Site Plan Application 19263. BACKGROUND: Two development projects located in the southwest quadrant of Bozeman, adjacent to South 19th Avenue between Grace Bible Church and West Graf Street, have collaborated to create one park to meet the required parkland dedication of Section 38.420. Bozeman Municipal Code (BMC). The Graf Street Apartments Master Site Plan Application 19309 would provide 6.10 acres and the Nexus Point Master Site Plan Application 19263 would provide 2.50 acres. The resulting 8.6-acre Lantern Park includes 4.43 acres of unrestricted, developed parkland and 4.17 acres of wetland along a watercourse with trail and pedestrian bridges as allowed in Section 38.410.100 BMC. Per the approval of the review authority, the watercourse/wetland and its setback area may be allowed within the design of a larger park area (Section 38.420.020.E, BMC). This configuration provides 50% park frontage which is the minimum according to Section 38.420.060. BMC. Due to the site restrictions imposed by the watercourse and the longer block length requirements along 19th Avenue and the direct pedestrian access to the park perimeters, the reduction of frontage may be approved (see Attachment C: Frontage Exhibit). As shown in the supplemental application materials, both developments have provided parkland and improvements-in-lieu of parkland up to the total maximum requirement for future residential density. In addition to Lantern Park, the applications have also proposed a linear park along the west side of the development with 0.43 acres in Nexus Point and 0.62 acres in the Graf Street Apartments property. The trail will be a 10-foot-wide concrete Class IA trail. 96 Both applications request to change the ratio of parkland to cash-in-lieu (CILP) from that required under the code which is the equivalent park dedication for 8 dwelling units/acre as land and 4 dwelling units/acre as CILP. Whereas the code requires 2.51 acres as land and 1.26 acres as CILP equivalent (3.77 acres); Nexus Point Master Plan proposes to provide 1.26 acres of land and $201,499.00 as CILP which is the equivalent to 2.89 acres (4.15 acres). For Graf Street Apartments, the code requires 4.23 acres of land and 2.11 acres as CILP equivalent (6.34 acres). The application proposes 2.71 acres of land and $275,317.50 which is equivalent to 3.95 acres of parkland (6.66 acres). Both applications will install improvements-in-lieu (IILP) rather than cash-in-lieu so the value to the City is greater. Cash-in-lieu (or Improvements-in-lieu) Criteria and Findings: Pursuant to section 38.420.030.A, BMC, the review authority may determine whether the park dedication must be a land dedication, cash donation in-lieu of land dedication or a combination of both. For the purposes of this section construction of park improvements above the minimum improvements required by ordinance may be allowed as a method of cash donation. The Bozeman City Commission delegated authority to the Parks and Recreation Director the authority to evaluate requests for authorization of accepting cash-in-lieu and improvements-in-lieu of parkland dedication through Resolution 4614. Further, Resolution #4784 establishes criteria for evaluation of requests for use of cash-in-lieu and improvements-in-lieu of parkland (IILP) dedication pursuant to section 38.420.030. This delegation includes approval of acceptance of improvements-in-lieu as a subset of cash-in- lieu. Additional guidance is given in Resolution 4784, subsection 3, which may preclude acceptance of cash/improvements-in-lieu even if other criteria are favorable. FINDINGS, CHECK ALL THAT APPLY The City’s preference for acquisition of real property for parks. The desirability and suitability of land within or proposed by the developer for parks and playground based on size, topography, shape, water supply, location or other circumstance. Proximity of the development to existing parks and recreation facilities. Type, function of and facilities including within nearby park(s) (i.e. pocket parks, special use park, neighborhood park, community park, etc.). The level of service (as defined in the adopted city-wide park master plan) provided by nearby parks(s). Correspondence with the City’s adopted city-wide park master plan. Whether the proposal provides an opportunity for partnerships, or whether grant funds are currently available. Whether the developer or future property owners are required to participate in the costs of maintenance of nearby park or recreational facilities. Long term availability of city funds for maintenance of the proposed facilities. The expressed preference of the developer. WHEN CASH-IN-LIEU WILL ALWAYS BE ACCCEPTED 97 Development is located within the B-3 zoning district Section 38.420.020.A requires payment of cash-in-lieu. FACTORS FOR CONSIDERAION OF IMPROVEMENTS-IN-LIEU are consistent with the master plan for the park where the improvements are proposed, Are included in the city’s most recently adopted city-wide park master plan, or Are included on the capital improvement program for the Parks and Recreation Department. Must be consistent with the city’s approved specifications for park equipment and improvement. Recommendation and Next Steps: The Recreation and Parks Advisory Board Subdivision Review Committee reviewed the parkland proposal on March 12, 2020 including IILP request and recommend approval of the Lantern Park Master Plan. Because the park is associated with site plan applications rather than a subdivision, public park easements will be granted to the City for each portion of Lantern Park, the linear park along the west side of the subdivision and the wetland areas in each development. Per the process in Section 1.8.2 of the Parks, Recreation, Open Space and Trails Plan, upon acceptance of the park by Parks and Recreation Department staff and receipt of final drawings, the Parks Division will prepare a resolution formally adopting the new park master plan and schedule the item for City Commission’s Consent Agenda. UNRESOLVED ISSUES: N/A ALTERNATIVES: As suggested by the commission. FISCAL EFFECTS: The park will be constructed by the developers. Upon acceptance of improvements, City Parks Division will maintain with funding by the Parks and Trails District. An Improvements Agreement will ensure construction of required park improvements so that Phase One Site Plan Applications may be approved for each development.
