PUBLIC ACCESS EASEMENT
Montana Bible Foundation Inc.,the GRANTOR,inconsiderationof $1.00 and forothergood
and valuable consideration,receiptof which is hereby acknowledged,grants to G-Force 1,
Limited LiabilityCompany (LLC),the GRANTEE and itsheirs,successors,and assigns,a
Public Access Easement ("the Easement")forthe use by the GRANTEE and the public over,
acrossand under a portionof the followingdescribedrealproperty,to-wit:
Lot 5A of the Amended Plat of Lot 5 and Lot 6 of Genesis Park Subdivision locatedin
the NEW of Section 23,Township 2 South,Range 5 East,P.M.M.City of Bozeman,
GallatinCounty Montana,according to the officialplatthereofon fileand of record in
the officeof the Clerk and Recorder of GallatinCounty,Montana (PlatReference:J-284-
D).
The Easement is more particularlylocated and described as shown on the attached
Exhibit A which by thisreferenceismade a parthereof.
The GRANTOR agrees:
(1)To allow the GRANTEE and/or the governing body with jurisdictionthe right to
constructa public and/or private roadway at GRANTEE's own expense in order to
provide access from Discovery Drive to Lot 1 of Minor Subdivision 235,locatedin the
SE1/4 of Section 23,Township 2 South,Range 5 East,P.M.M.,GallatinCounty,
Montana,as more particularlyshown on Exhibit A and in accordance with applicable
laws and regulations.Said Lot I shallbe consideredthe benefittedor dominant tenement
forthe Easement.
(2)That GRANTOR islawfully seizedand possessed of the realproperty described above,
thatithas the lawfidrightto convey the property,or any partof it,and thatitwillforever
defend the titleto thispropertyagainstthe claims of allpersons.
(3)That thatthe GRANTEE and the public may peaceably hold and enjoy the rightsand
privileges herein gramed without any interruption by the GRANTOR.After
commencement of roadway construction,GRANTOR agrees not to gate or fence the
Easement.The terms,covenants and provisionsof thisPublic Access Easement shallrun
with the land and shallextend to and be binding upon the heirs,executors,administrators,
personalrepresentatives,successorsand assignsof thepartieshereto.
