HomeMy WebLinkAbout2020-08-27.Norton East Ranch Ph. 5 PP_RPAB Sub Rev Memo-DRAFT MEMORANDUM – DRAFT* TO: Community Development FROM: Addi Jadin, Park Planning and Development Manager Mitch Overton, Parks and Recreation Director DATE: August 27, 2020 SUBJECT: 18278 Norton Ranch Phase 5 Preliminary Plat - Parkland Dedication Requirements *Draft to be updated with recommended comments or conditions suggested by the Subdivision Review Committee Summary of Parkland Proposal and Code Compliance The parkland proposal for Norton Ranch Phase 5 consists of parkland totaling 8.76 acres within 5 parcels. A large amount of this land is within watercourse setback areas and the parkland contribution is reduced accordingly; however the inclusion of the watercourses and setback areas within the larger park parcels was allowed with the approval of the Park Master Plan for Norton Ranch Subdivision approved on September 27, 2010 and previous phases. Along the west edge of the subdivision which coincides with Aajker Creek, a linear park corridor roughly 50 feet wide runs north to south and is a continuation of linear parkway provided in Phase 3 of the subdivision to the south and continuing in the Lake at Valley West Subdivision to the north. The majority of this linear park is within wetland setback. This trail segment is classified as a Class I trail and is proposed as a 10-foot-wide asphalt trail. At the northwest corner of Phase 5 adjacent to the linear park, a 1.769-acre park is proposed including 0.785-acre retention pond. This park meets the minimum 50% street frontage requirement and mitigates for the remaining 50% with trails and sidewalk around the perimeter. This park includes a climbing boulder and bike racks and connects to a larger park parcel at the eastern edge of the subdivision via a linear open space along Vaughn Drive. Applicants are asked to add specific language to the Stormwater Maintenance Plan and covenants to state that the HOA shall be responsible for the long-term maintenance of the retention pond in the park (despite the creation of the Parks and Trails District). The large park parcel is 5.636 acres with 1.678 acres of wetland. Details for the park lot (see application document “L103 Park Plan 04-24-2020.pdf”) show a playground area with parking lot along a Class II gravel pathway on the west side of the wetland area and east of residential Lots 2-8 of Block 21. The Class II gravel pathway corresponds with a trail shown on the PROST Plan Trail Map and wayfinding signage locations are indicated on the park detail sheets to direct people to midblock crossing that connects to the open space and parks trail system in the Lakes at Valley West. The parking lot and trail connections mitigate the loss of parkland frontage. Review Comments and Discussion Items: 1. Is it necessary to have a separate lot for the parkland and the linear trail at the northwest corner of the site? 2. Is the sidewalk adjacent to Park 5B the city standard 6’ sidewalk for parkland frontage? 3. “App. G –Master Plan Write-up” includes an error that results in incorrect remaining parkland balance. Please update to reflect that an additional 1.97 acres has been provided This error is carried over to “App G. – Master Park Plan as well” and on the Preliminary Plat Conditions of Approval Sheet. 4. Please include the dollar value of parkland improvements that are in addition to the standard improvements to the Parkland Tracking table. Advisory Comment: It is suggested on the next phase to account for the value of all improvements that are in addition to the standard improvements such as playgrounds, benches, trails, additional landscaping. 5. No realty transfer certificates or deeds documents are provided for the park parcels. 6. Please clarify how the conservation easement and permits are transferred to the City of Bozeman. 7. The Stormwater Management plan must specifically state that maintenance of the retention pond within the park parcel is the responsibility of the HOA. 8. Article 6.1(d) of the covenants must specifically state that maintenance of the retention pond within the park parcel is the responsibility of the HOA. 9. Statements regarding waiver of right to protest the creation of the parks and trails district and indicating that parkland is maintained by the HOA may be removed from the plat and covenants, with the exception of the comments regarding retention ponds.
