Sincerely, Stephan Custer 14 September 2020 To: Bozeman City Commission Fr: Stephan Custer 39 Swift Water Drive Bozeman, MT 59715 Re: Urban Blight Designation at the Idaho Pole Superfund Site Resolution 5145 This letter represents my opinion and does not reflect the position of any board, subcommittee or committee on which I sit. I was present at a presentation regarding Resolution 5145 at a recent Local Water Quality District Board Meeting. At that meeting, I understood that no land zoned residential would be included in the District. I checked that statement by drawing the proposed boundary on a map that showed zoning. I believe there is an error on that Blight Designation map in that a sliver of land zoned residential is included in the Blight Designation area. (See the R-S sliver upper center below). I am further concerned that the Commission and the Public mistakenly believe that the Manufacturing Zoning precludes uses that would put citizens at risk. I hope I am wrong but am concerned because the Manufacturing Zones do allow some uses that in my view are unwise. For example: Restaurants, Retail, Ambulance Services, Health and Exercise Establishments, and Medical and Dental offices. Indeed, some of the Blight Area lies directly over the plume as I understand it. (See below.) That is not necessarily unexpected until one considers industrial (M1 andM2) permitted uses. The following show some of the uses permitted. Are these uses that are wise in an area with a plume below? (I apologize for my crude scaling above and my limited screen captures below, I do not have access to a GIS and the screen shots come from City Zoning documents I found on line. I have not included all screen shots, but the ones attached I thought were instructive. Some uses make sense, but I hope some will appear as poor to you as they do to me.)
