Consider the motion: I move to approve Consent Items 1-18 as submitted.
H. Public Comment - Please state your name and address in an audible tone of voice for the record. This
is the time to comment on any matter falling within the scope of the Bozeman City Commission. There
will also be time in conjunction with each agenda item for public comment relating to that item but
you may only speak once. Please note, the City Commission cannot take action on any item which
does not appear on the agenda. All persons addressing the City Commission shall speak in a civil and
courteous manner and members of the audience shall be respectful of others. Please limit your
comments to three minutes.
I. Action Items
1. Resolution 5053, Establishing a Tobacco Free Policy for City of Bozeman Parks (Jadin)
Consider the Motion: I move to adopt Resolution 5053 establishing a tobacco free policy for City of
Bozeman Parks.
2. Certificate of Appropriateness to Allow for a Zoning Deviation for the Expansion of an Existing
Carriage House/ Dwelling-unit at 423 S. Tracy Ave. The Deviation Specifically Cited from the
Following Sections of the Bozeman Municipal Code (BMC): Section 38.320.030.C to Allow an
Addition to an Existing Historic Carriage House/ Dwelling Unit with 145 Square Feet Within a
Front Setback (Gonzalez)
Consider the Motion: Having reviewed and considered the application materials, public comment, and all
other information presented, I hereby find application 20-231 meets the criteria required for approval and
move to approve the 423 S. Tracy Addition application for a deviation request from Section 38.320.030.C
of the Bozeman Municipal Code to allow for the construction of an addition to a carriage house/ dwelling
unit with 145 square feet within a 15’ front setback, as shown in the application materials.

3. Resolution 5145, Adopting Findings of Blight and Establishing the Necessity of Rehabilitation
and Redevelopment of the Pole Yard Area (Fine)
Consider the Motion: I move to approve Resolution 5145 adopting the findings regarding the existence
of conditions contributing to blight within the Pole Yard area of Bozeman provided in the Statement of
Blight, and hereby declare that such areas of blight exist and that the rehabilitation, redevelopment, or a
combination thereof of the area is necessary and in the interest of the public health, safety, morals, or
welfare of the residents of Bozeman.
4. Appointments to the Recreation and Parks Advisory Board (RPAB) (Maas)
Consider the Motion: I move to appoint four members to the Recreation and Parks Advisory Board for the
terms specified by the position.
