RESOLUTION 5211
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, ESTABLISHING CITY MANAGER AUTHORITY TO USE CITY
FACILITIES TO SUPPORT PROGRAMS FOR FAMILIES AND BUSINESSES
AFFECTED BY THE COVID-19 PANDEMIC.
WHEREAS, The City of Bozeman’s Declaration of Emergency dated March 16, 2020
continues as does the Montana Governor’s Executive Order No. 2-2020 declaring a state wide
emergency related to the COVID-19 pandemic; and
WHEREAS, Child care serves a vital role in allowing parents to continue working,
which has essential public health, economic and social impacts; and
WHEREAS, According to the May 2019 (pre-Pandemic) Bozeman Area Labor Report,
child care services in the Bozeman area are both expensive and significantly undersupplied and
the lack of availability of child care services is a barrier to entering and remaining in the work
force in Bozeman; and
WHEREAS, The COVID-19 pandemic has brought drastic changes to Montana’s child
care landscape, according to the Montana Department of Public Health and Human Services
(DPHHS); and
WHEREAS, The coronavirus pandemic has had significant effects on child care
program costs in the areas of staffing availability and wages, equipment, and cleaning supplies and
continues to disrupt the stability of child care programs, as staff, families and children may need
isolation or quarantine; and
WHEREAS, During the current Declaration of Emergency child care providers need
resources including access to additional facilities to accommodate physical distancing

requirements and the use of City facilities for such purposes may mitigate impacts to families,
workers, and businesses as Bozeman’s schools reopen on a limited basis.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana, that
Section 1 – Use of City Facilities in Support of Providers
To assist in mitigating the impacts of the COVID-19 pandemic, the City Manager is hereby
authorized to enter into agreements with child care service providers to provide child care services
in facilities owned by the City. The City Manager is authorized to designate City facilities which
may be used for this purpose. The use of City facilities for child care services must comply with
all applicable zoning and building regulations. The City Manager may make the use of City
facilities available for a fee or no fee and may establish additional requirements.
Section 2– No Fee for Business Licensing or Special Temporary Use Permits
for Child Care Services
The City’s Director of Community Development may waive fees related to a child care service
provider obtaining a special temporary use permit or business licensing.
PASSED, ADOPTED, AND APPROVED by the City Commission of the City of
Bozeman, Montana, at a regular session thereof held on the 25th day of August, 2020.
