I am an owner in the Saccocia PUD as modified by the Lowe’s PUD (“Master PUD”). I
understand that GMD Development, LLC desires to create its own PUD (“Lot 3 PUD”) within
the Master PUD in order to develop Lot 3A of COS 407A. I understand the proposed Lot 3A
PUD will involve the following changes to the Master PUD:
A partial reduction (approximately 5%) of the Master PUD’s Flexible Open
Space, all of which will occur on Lot 3A and a modification of the Master PUD’s
Performance Points, originally obtained through Open Space to be replaced with
Affordable Housing.
I understand that my signature is required on the Lot 3A PUD application because of the above
changes to the Master PUD. I hereby approve the above change to the Master PUD and grant
limited authorization to GMD Development, LLC, to sign the Preliminary Lot 3A PUD
Application and corresponding Development Review Application on my behalf as an owner in
the Master PUD.
To the extent that there are no other changes to the Master PUD required under the Final Lot 3
PUD Application, this authorization is automatically extended to the Final Lot 3 PUD
Application. Any site plan specific changes that relate only to the development of Lot 3A of
COS 407A and does not affect other lots within the Master PUD shall not affect my
authorization for signature on the Final Lot 3A PUD Application. I hereby hold the City of
Bozeman harmless from any claims or actions arising out of the City of Bozeman’s reliance on
this document. The person signing this form on behalf of the entity listed below is an authorized
agent of the entity and has the authority to bind the entity to this authorization.
