Park Street Butte, MT 59701-9989 UNDERGROUND UTILITY EASEMENT Lyon Investments,LLC, a Texas Corporation,18601 LBJ Freeway Suite 525 Mesquite Texas 75150,the GRANTOR, in consideration of one dollar and other good and valuable consideration, receipt of which is acknowledged,does hereby grant to Northwestern Corporation, d/b/a Northwestern Energy, a Delaware Corporation, of 11 E. Park Street, Butte, MT 59701- 9989, the GRANTEE, its successors and assigns,an easement 20 feet in width upon which to construct, operate, maintain, replace, upgrade and remove an underground electric line, communications system, gas line, and necessary appurtenances over, under, along, and across that certain a strip of land located in Gallatin County, Montana, to be located on the following described real property: Lot 5A,Amended Plat of Lot 5 and Lot 6, Gallatin Center Subdivision P.U.D. Phase 1, City of Bozeman,Gallatin County, Montana, and located in the Northeast Quarter of Section 35, Township 1 South, Range 5 East of P.M.M., Gallatin County, Montana. The easement is more particularly shown and dimensioned on the attached Exhibit A,which by this reference is made a part hereof. TOGETHER with reasonable right of access to and from the easement area over lands of the Grantor using existing roads and trails where practicable; the right to use and keep the easement area free and clear of any and all obstructions or structures, except fences; and the right to clear and remove all timber, brush,or vegetation outside of easement area that may, in the Grantee’s sole opinion, endanger the powerline, communications system, gas line, or necessary appurtenances.
