Under what circumstances would it be appropriate for a student to resist their teacher or school staff in order to protect their physical person? According to the Fourth Amendment of the U.S. Constitution "The right of the people to be secure in their persons... against unreasonable searches or seizures" our students, as full U.S. citizens retain the right to be secure. Please let me know so that I may reassure my community and my children that it is safe to return to school. From:Ryan Garrity To:Agenda Subject:Concerns regarding forced testing and drug administration to students returning to school this Fall Date:Monday, July 27, 2020 11:14:36 AM Bozeman City Commision and Staff, While this issue directly concerns how to respond if our schools become a real threat to our children, ultimately the safety of all children in the Bozeman community is a concern of thecity as well. Recently, the Federal government placed an initial order with the drug manufacturer Pfizer and BioNTech for 300 million doses of Hydroxychloriquine as part of "Operation WarpSpeed." There are two very alarming statements in the announcement which Pfizer made concerning this order which appear to "predict" the future, and which appear to show thatPfizer and BioNTech are operating with insider information as to events that are to take place in the near future. The two statements are: "Americans will receive the vaccine for free consistent with U.S. government’scommitment for free access for COVID-19 vaccines." "We made the early decision to begin clinical work and large-scale manufacturing at ourown risk to ensure that product would be available immediately if our clinical trialsprove successful and an Emergency Use Authorization isgranted." (https://www.pfizer.com/news/press-release/press-release-detail/pfizer-and-biontech-announce-agreement-us-government-600) The first statement does not say "Americans can" or "Americans will be able to" but rather "Americans will" which is a direct and forceful statement. Secondly, they appear to haveforeknowledge that this forced administration will occur according to a predetermined sequence namely when an Emergency Use Authorization is granted. This announcement isobviously not a neutral statement by a third party manufacturer but rather it references future events and actions by other independent parties that do not relate to Pfizer or BioNTech'slimited role as a neutral drug manufacturer. Furthermore, an Emergency Use Authorization, according to the FDA's own website does not in fact authorize the administration of any test or any drug, however the terminology usedappears to say the opposite. The FDA statement regarding the Emergency Use Authorizations (EUA's) is as follows: "Under section 564 of the Federal Food, Drug, and Cosmetic Act (FD&C Act),the FDA Commissioner may allow unapproved medical products or unapproved uses of approved medical products to be used in an emergency to diagnose, treat, or prevent serious or life-threatening diseases or conditions caused by CBRN threat agents when there are no adequate, approved, and availablealternatives." (https://www.fda.gov/emergency-preparedness-and-response/mcm- legal-regulatory-and-policy-framework/emergency-use-authorization) The statement "may allow" does not give them the authority to carry out the forced testing oradministration, but rather to not block this type of action. However, more importantly, they are claiming the right to use "unapproved medical products" in "unapproved uses." Furthermore, they claim they can do this when there are no "adequate, approved, and available alternatives" which is something that could never be decisively proved at any onegiven moment in time. The Fourth Amendment protects all citizens of the United States against "unreasonable searches and seizures." My question to you, Mayor Mehl, is first, whether or not, in light ofthe information and statements provided, you believe the Pfizer announcement appears to contain prescient information and secondly do you believe that the EUA's of the FDA meet thedefinition of "reasonable?
