Gauranteed Maximum Price for Bozeman Public Safety Center Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Chuck Winn, Assistant City Manager SUBJECT: Approve Guaranteed Maximum Price (GMP) Amendment for Construction of the Bozeman Public Safety Center. MEETING DATE: July 27, 2020 AGENDA ITEM TYPE: Action RECOMMENDATION: Authorize the City Manager to sign GMP Amendment to Contract for Construction with Langlas and Associates for construction of the Bozeman Public Safety Center. RECOMMENDED MOTION: After listening to the presentation by staff and considering public comment, I move to authorize the City Manager to sign the Guaranteed Maximum Price amendment with all alternates to the Contract for Construction with Langlas and Associates for the construction of the Bozeman Public Safety Center. BACKGROUND: On August 5, 2019, the City Commission approved the Contract for a General Contractor/Construction Manager for the Bozeman Public Safety Center (BPSC). That contract authorized preconstruction and construction services for the project including work necessary to develop a guaranteed maximum price (GMP) for construction. Staff has spent the last year designing the project and refining a budget based on changing market conditions, commodity and supply pricing, and cost of labor. Through this work and a competitive bidding process in accordance with Montana law, Langlas has determined a GMP for construction. The GMP represents the maximum price the City will pay to complete the BPSC as described in the contract documents and includes all the alternate components which were separated from the base project due to budget concerns. These include: Alternate #1 Patrol vehicle canopies within the secured parking area Alternate #2 Fire vehicle canopies adjacent to fire station Alternate #3 Snow melt systems around key overhead doors and entry points Alternate #4 Small storage building for site maintenance equipment Alternate #5 Argon fill glazing for energy efficiency Alternate #6 Roller shades for solar protection and energy efficiency Alternate #7 Solar Tubes – energy efficiency Alternate #8 Solar photovoltaic system (solar panels) energy efficiency Alternate #9 Ultraviolet disinfectant for heating, ventilation and air conditioning systems It is important to note the project may cost less to build than the number represented in the GMP, in fact, it is reasonable to believe the actual costs will be less. The City will realize all cost savings in the project including unspent contingency monies. The total guaranteed maximum price for completion of the work described in the complete set of construction documents, including the nine alternate work items, is $36,436,485.00 which is equivalent to $389.59 a square foot – well within the range of our initial estimates. Construction is anticipated to be completed in April of 2022. UNRESOLVED ISSUES: None. ALTERNATIVES: None identified FISCAL EFFECTS: The cost of the GMP is included within the overall project budget and will be paid from bonds sold after the voters approved this project in November 2018. The amount is appropriated in this year’s budget. (“Contractor”) for the Bozeman Public Safety Center, hereby authorizes the entire Work for the project as described in the complete set of Construction Documents prepared by ThinkOne and AndersonMasonDale Architects, outlined below. The Contract Sum is guaranteed by the Construction Manager not to exceed Thirty Six Million Four Hundred Thirty Six Thousand Four Hundred Eighty Five Dollars and Zero Cents ($36,436,485.00). This amount may only be altered by Amendment or Change Order executed by the parties in accordance with the Contract Documents. See attached Exhibit 1 for an itemized statement of the Guaranteed Maximum Price organized by trade categories, allowances, alternates, contingency, the Construction Manager’s Fee, and other items that comprise the Guaranteed Maximum Price and information on which it is based.
