RE: Headwaters Academy Site Plan and CUP Application 19495
Dear Applicants,
The Site Plan and Conditional Use Permit for the above-referenced project was unanimously approved 5-0 by the
City Commission on July 13, 2020 with the conditions that can be found in the attached conditional use document
and outlined in the City Commission staff report that you received prior to the public hearing, with the addition related
to the potential historic gas line. Please be informed that ANY changes from the final plan or application will need to
be reviewed by the Department of Community Development.
The document attached to this letter that must be executed, recorded and a copy of the recorded document must be
returned to our office per the Bozeman Municipal Code and prior to final approval of the conditional use permit. All
conditions of approval must be met prior to the service of alcohol on the premises.
As the applicant, you must comply with all provisions of the Bozeman Municipal Code, which are applicable to this
project. All unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does
not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or
state law.
You have the right to appeal the decision of the City Commission pursuant to the provisions of the Bozeman
Municipal Code. If a valid appeal is filed, no further action on the project may proceed until a decision on the appeal
is made by the District Court, and the Community Development Department and Building Division will not be able to
approve any building permits or to perform any inspections related to this application.
