PUBLIC STREET AND UTILITY EASEMENT
Gallatin Center Limited Partnership. GRANTOR, in consideration of$ 1.00 and for other and
valuable considerations, receipt of which is acknowledged, grants to The City of Bozeman, a
municipal corporation of the State of Montana, with offices at 121 North Rouse Avenue,
Bozeman, Montana 59715, GRANTEE, its successors and assigns, a perpetual street and utility
easement for the use of the public, in, through, and across a strip of land situated in Gallatin
County, Montana, located on the following described real property:
Common Area Block 1, Final Plat of Phase I of the Gallatin Center Subdivision PUD Phase 4
Located in the SE '/4 of Section 35, T1S, RSE, P.M.M.
City of Bozeman, Gallatin County, Montana
The easement is more particularly described on the attached Exhibit A which by this
reference is made a part hereof.
The GRANTOR states that he possesses the real property described above and that he has
a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto.

All that certain Public Street and Utility Easement over and across the Common Area, Final Plat of
Phase 1 of the Gallatin Center Subdivision P.U.D., Phase 4 (Plat Reference J-423), located in the
NE1/4 and SE1/4 of Section 35, Township 1 South, Range 5 East, P.M.M., City of Bozeman, Gallatin
County, Montana, being more fully bounded and described as follows:
Beginning at the Southwest corner of the intersection of Max Avenue and Cattail Street,thence along
the West right-of-way line of Max Avenue South 00°04'11"West, a distance of 197.78 feet;thence
through said Common Area the four (4) following courses; 1) along a curve turning to the leftwith an
arc length of 52.61', with a radius of 138.38',the radial bearing thereof being North 89°55'49"West;
2) along a reverse curve turning to the right with an arc length of 37.84',with a radius of 213.50'; 3)
North 11°33'38" West, a distance of 59.24 feet;4) along a curve turning to the left with an arc length of
67.53',with a radius of 75.00'to a point on the South right-of-way line of Cattail Street;thence along
said right-of-way line North 89°46'35" East, a distance of 72.35 feet to the Point of Beginning.
