PUBLIC STREET AND UTILITY EASEMENT
Gallatin TR LP, GRANTOR, in consideration of$1.00 and for other and valuable
considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal
corporation of the State of Montana, with offices at 121 North Rouse Avenue, Bozeman,
Montana 59715, GRANTEE, its successors and assigns, a perpetual street and utility easement
for the use of the public, in, through, and across a strip of land situated in Gallatin County,
Montana, to be located on the following described real property:
Lot 12-C Amended Plat Lot 12 Phase I of the Gallatin Center Subdivision PUD, Phase 4
Located in the SE '/4 of Section 35, TIS, RSE, P.M.M.
City of Bozeman, Gallatin County, Montana
The easement is more particularly described on the attached Exhibit B which by this
reference is made a part hereof.
The GRANTOR states that he possesses the real property described above and that he has
a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto.

All that certain Public Street and Utility Easement over and across Lot 12-C of the Amended Plat, Lot
12, Phase I Gallatin Center Subdivision P.U.D., Phase 4 (Plat Reference J-423-A), located in the
NE1/4 of Section 35, Township 1 South, Range 5 East, P.M.M., City of Bozeman, Gallatin County,
Montana, being more fully bounded and described as follows:
Beginning at the Northwest corner of the intersection of Max Avenue and Cattail Street,thence along
the North right-of-way line of Cattail Street South 89°46'35"West, a distance of 72.76 feet;thence
through said Lot 12-C the five (5) following courses; 1) along a curve turning to the left with an arc
length of 64.37',with a radius of 103.50',the radial bearing thereof being North 24'22'10"West;2)
North 29°59'50" East, a distance of 22.23 feet; 3) along a curve turning to the left with an arc length of
16.71',with a radius of 44.00; 4) North 08°14'00" East, a distance of 12.85 feet; 5) along a curve
