PUBLIC PARK EASEMENT
ACROSS LOT 1,BLOCK 1, KAGY CROSSROADS SUBDIVISION
CITY OF BOZEMAN, GALLATIN COUNTY,MONTANA
Annex of Bozeman, LLC, an Indiana limited liability company, of 409 Massachusetts Ave, Suite
300, Indianapolis, IN 46204, GRANTOR, does hereby grant to the City of Bozeman, a
Municipal Corporation of the State of Montana, with offices at 121 North Rouse Avenue,
Bozeman, Montana 59715, GRANTEE, public park easements (for passive and active recreation
and similar uses typical of a public park, but not for parking, residential or commercial use, or
for any other purpose) in, through, over and across the following described property situated in
the City of Bozeman, Gallatin County, Montana:
Lot 1, Block 1, Correction Plat of Kagy Crossroads Subdivision [Plat J-328A], according
to the plat thereof, on file and of record in the office of the Clerk and Recorder, Gallatin
County, Montana, and located in the Southeast Quarter of Section 14, Township 2 South,
Range 5 East of P.M.M., City of Bozeman, Gallatin County, Montana.
This easement is more particularly shown and dimensioned on the attached Exhibit A, which by
this reference is made a part hereof.
The GRANTOR states that it possesses the real property described above and that it has a lawful
right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peacefully hold and enjoy the rights and
privileges herein granted without any interruption by the GRANTOR. The terms, covenants and
provisions of this easement shall extend to and be binding upon the heirs, executors,
administrators,personal representatives, successors and assigns of the parties hereto.
