CASH-IN-LIEU OF WATER RIGHTS
Per the correspondence included in this section with Brian Heaston at the City of Bozeman, a
4.08 AF credit exists from a previously transferred water right. Using 0.124 AF/Units, 78
dwelling units in Phase I, and $6,000/AF:
78 units x 0.124 AF/unit = 9.672 AF
9.672 AF – 4.08 AF (credit) = 5.592 AF
5.592 AF x $6,000/AF = $33,552
Per correspondence with Brian Heaston, numbers will be finalized prior to final approval of the
site plan.

Need confirmation from DNRC that a exempt well is allowable. May be trickier to get one given the pre‐plat came after
the combined‐appropriation rule reversion. Keep that in mind.

We’ll finalize the fee number prior to final approval of the site plan. We’re just talking preliminary fee right
now. Landscape irrigation demand could play into the demand and fee. It’s a large enough development where we
could talk about a fee reduction if the developers goes high efficiency with toilets, showerheads, and clothes washers in
the units. For ballparking the developers proforma, you’re about there. It’s likely ~6AF with the credit applied => ~$36k

Thanks Brian. You’re right, in the sheet I sent you I didn’t include the two units in the clubhouse. And you’re also right
that there was some confusion about the lot name.
No pool. I’ll find out about the landscaping irrigation supply.
So for this Phase I:
78 units x 0.124 AF/unit = 9.672 AF.
9.672 AF – 4.08 AF = 5.592 AF.
Would we just figure out what that costs at site plan application, which we’re submitting next week.

Hi Juliene – 76 units at .124 AF/unit ballparks for now. We’ll refine with the site plan filing. Need to include demand
estimate for the clubhouse. If it has a pool it’ll be a significant addition to the annual demand. What’s the plan for
landscape irrigation supply?
FYI ‐ The proper legal description for the tract of record is lot 1, block 25 of ph 7. There’s a 4.08 AF credit for this tract
from water right transfer Walt completed. See part 3 of attached agmt.

Ph 6, S03, T02S, R05R, Lot 1R‐6, Plat J‐637. The CIL sheet attached is for Phase I of the development, which will consist
of x5 12‐plex units (total of 60 DU), x4 4‐plex units (total of 16 DU).
