Site Plan Review Comments Narrative
Section 2 – Conditions of Approval
Please note that these conditions are in addition to any required code provisions identified in this
report. The following conditions are specific to the development:
1. The applicant is advised that unmet code provisions, or code provisions that are not
specifically listed as conditions of approval, does not, in any way, create a waiver or
other relaxation of the lawful requirements of the Bozeman Municipal Code or state law.
Response: This condition is acknowledged
Section 3 – Required Code Corrections
PLANNING COMMENTS:
1. BMC 38.220.080 – Site plan submittal requirements. Include lot coverage calculation
and percentage on the cover sheet. If phasing is proposed, include a phasing plan.
Response: The lot coverage calculation and percentage were shown on the Cover Sheet
with the initial submittal. It was, and is, listed under “Site Area”
2. BMC 38.360.240.E – Useable open space. Provide an amenity plan for the open space
within the rear setbacks of the buildings on the west side of the lots. Rear setbacks can be
used for open space provided they meet required design criteria. Open space must be
“configured to accommodate human activity such as outdoor eating, gardening, toddler
play, etc.” Provide fence details for the open space located in the front yard setback that
meets the standards of section 38.350.060.
Response: Useable residential open space for the rear units are provided by “Ground
level private outdoor space” per UDC 38.520.060.B.1.b – “Ground level private
outdoor space. One hundred percent of the required open space may be provided
by ground level outdoor space that is adjacent and directly accessible to the
subject unit.” A cedar fence detail has been added to sheet C2.0.
BMC 38.350.050 – Setback encroachments. Dimension the steps and portions of the stoops
that are within the front and rear setbacks to illustrate they are within the 5’ maximum
allowable.
Response: Dimensions have been added showing the encroachment of the stairs is less
than 5’ into the front and rear yard setbacks.

3. 38.320.030.C – Building height. The maximum allowable building height for a slope of
2:12 is 32’. For buildings with a 40’ height the roof slope must be 6:12 or greater but less
than 9:12. This will require a redesign.
Response: The Architect has indicated that this issue has been resolved with the
Planner.
4. BMC 38.540.050.A.1.a – Parking. On-street parking. Show dimensions accounting for
each of the 5 on-street parking that are being shown in the parking calculations.
Response: “Typical” dimensions have been added to the on-street spaces.
NorthWestern Energy
1. Gas meters must not be inset
Response: The Architect has indicated that this issue has been resolved with
Northwestern Energy.
2. Show existing facilities in the 12’ easement and do not plant trees on them
Response: The underground power is now shown in the utility easement
3. Services for 3271 need to be on the north sides of the buildings and 3233 on the south sides
of the buildings
Response: The services are now shown on the north end of bldg 3271 and south end of
bldg 3233 as requested.
4. Provide minimum 5’ separation between sewer/water and private utilities
Response: The sewer service and private utilities are designed at 5’ apart

2. IBC Section 903.2.8, as amended by the State of Montana, requires fire sprinklers and
alarm for a residential structure over two stories.

3. These units are 3 stories, so fire sprinklers and alarms are required.
Response: The Architect has indicated that this issue has been resolved and fire
suppression sprinklers are not required.

1. With the use of individual totes, and the understanding that tenants are responsible for
placing totes on street for collection Solid Waste approved this plan. (totes must be
placed on street because as planned we will not back into parking lot to empty totes.)

ENGINEERING COMMENTS:
Easements
1. BMC 38.410.060.: Easements
a. The applicant must record the mutual access and drainage easements covering both
properties and provided a copy of the recorded document prior to site plan approval.
Response: This condition is acknowledged. A copy of the recorded mutual access and
drainage easements will be filed and a copy provide to the city prior to final site plan
approval.
b. The civil plans are unclear if the 10 utility easement, indicated on the plat, is shown.
Please clarify the plans/change the line type prior to approval.
Response: The 12’ utility easement is shown and labeled on the site plan.
Stormwater
2. BMC 38.410.080 and 40.04.500.A: Requirement to control and reduce stormwater
pollutants
a. The stormwater design report includes a reduction in required retention volume
based on infiltration. The City’s design standard do long allow for this reduction.
The calculations must be revised and the system increased as necessary prior to site
plan approval.
Response: The design report has been revised to not include a reduction in
volume based on infiltration
b. The maximum groundwater elevations must be included in the stormwater report
and should be vetted by the engineering certifying the drainage design.
Additionally, the subsurface systems are proposed to be deeper than the 3.5ft from
the existing ground. Storage proposed below the seasonal high will not be
considered in meeting the City’s storage requirements.
Response: Groundwater monitoring data has been included in the report and the
subsurface basin has been redesigned to reduce the depth of the basin. Based
on the revisions it is anticipated the bottom of the basin will be
approximately 2.5’ above high ground water levels.
c. Please demonstrate reasonable maintenance access to the subsurface stormwater
system located at the northwest corner with the equipment to flush, pump, and/or
vacuum the systems as described in the maintenance plan. If reasonable

maintenance access cannot be demonstrate the system must be relocated or an
alternative designed presented.
Response: Access to the subsurface stormwater system will be provided via
access between the buildings, across the lawn.
Transportation
3. BMC 38.400.090.D.2: Access
a. Table 38.400.090-1 the access deviation request must be stamped by professional
engineer registered in the State of Montana.
Response: The access deviation request has been stamped and is included in this
resubmittal.
