HomeMy WebLinkAbout19- Release and Reconveyance of Easement - Revesco (USA) Properties of Bozeman, LP - Lot 12-A-1 of Lot 12-A, Lot 12-B, and Lot 12-C, Phase 4 of Gallatin Center Subdivision PUD, Phase 1 Return tt©: PLATTED ` City of Bozeman City Clerk P® Box 1230 R®iteman, MT 59771-1230 2676787 Ergc Semerad - Ga31a5in©Counnt,, MT, PM Fee $21misc 00 IIIIII IN 1111111111111111111111111 RELEASE AND RECONVEYANCE OF EASEMENTS COMES NOW the City of Bozeman, 121 N.Rouse Ave,MT 59715,a Municipal Corporation of the State of Montana hereinafter("GRANTOR") and does hereby release and reconvey the following described easements unto REVESCO(USA)PROPERTIES OF BOZEMAN,LP,a Colorado limited partnership of 2731 17th Street,Suite 300, Denver,Colorado 80211,as follows: WITNESSETH WHEREAS the Grantor is the legal record title holder of utility easements situated across Lot 12-A-1 of the Amended Plat of Lot 12-A Lot 12-B and Lot 12-C of the Final Plat of the Amended Plat of Lot 12 Phase 4 of the Gallatin Center Subdivision P.U.D.,Phase 1,a tract of land located in the NE'/4 of Section 35 Township 1 South Range 5 East,P.M.M..City of Bozeman,Gallatin County Montana according to the official plat thereof on file and of record in the office of the County Clerk and Recorder of Gallatin County Montana (Plat Reference: 1 as more particularly shown and described on Exhibit A attached hereto; WHEREAS the above utility easements were granted by GALLATIN TR,LP,a Texas limited partnership by the following instruments: Water Pipeline and Access Easement and Agreement recorded on December 19,2002 as Document No. 2091611 in the office of the Clerk and Recorder of Gallatin County,Montana Sewer and Water Pipeline and Access Easement and Agreement recorded on August 21, 2002 as Document No.2078745 in the office of the Clerk and Recorder of Gallatin County,Montana,which was replaced and superseded by the aforementioned Water Pipeline and Access Easement and Agreement recorded as Document No.2091611 Final Plat of the Amended Plat of Lot 12,Phase 1 of the Gallatin Center Subdivision P.U.D.,Phase 4(Plat Reference:J-423-A);Final Plat of Phase 1 of the Gallatin Center Subdivision P.U.D.Phase 4(Plat Reference:J- 423);and the plat of Gallatin Center Subdivision P.U.D.Phase 2(Plat Reference:J-348); WHEREAS no public utilities are located within the easements to be released and the vacation of the said easements will not adversely impact the Grantor's or the Public utility companies' interests, WHEREFORE, the Grantor does hereby release and reconvey to REVESCO (USA) PROPERTIES OF BOZEMAN,LP,a Colorado limited partnership, those portions of the utility easements located on the above described real property as set forth on Exhibit A attached hereto together with any right,title,or interest that the Grantor may have in said utility easements as set forth on the Exhibit A attached hereto and incorporated herein by reference as though fully set forth and shown on the Exhibit: This reconveyance shall not affect the remainder of those easements shown on said Book of Plats J,page 423 in the Clerk and Recorder's office of Gallatin County,Montana. n N� _ �1_ DATED this C9 day of I/� ,2020.
