Planning Comments
1. As noted under Engineering comments please dedicate Palisade Drive and Stafford Avenue as right
of way. This will lower the long-term taxes to the project and make public administration of the
streets easier.
Response: The preliminary plat proposes to dedicate Palisade Drive and Stafford Avenue as
requested by City staff.
2. With the dedication of Palisade Drive the park will change lots to 3A-2. This does not affect the
approved park design or master site plan requirements.
Response: The park is proposed as 2 lots, to coincide with the phasing of the approved
master plan.
3. The water rights agreement established with the master site plan will meet the requirements of
38.410.130.
Response: Noted. The water rights agreement was completed as part of the Master Site Plan
and Phase 1 Site Plan approval.
4. The formal application must include all required certificates on a title sheet and a conditions of
approval sheet must be provided.
Response: The plat has the required certificates and a conditions of approval sheet.
5. Public notice materials, including fees and labels for certified letters to adjacent property owners,
must include all individual units of all condominium projects which are wholly or partially within the
noticing distance.
Response: The noticing requirements includes all property within the noticing distance,
including individual units within condominium developments.
Engineering Comments
1. Not all linework for existing utility easements was visible on the Plat. See screenshot with markups
below. Add all required linework.
Response: Linework for easements has been included in the preliminary plat.
2. Remove the curb removal, water and sewer service connections hatch from the perimeter of the
property boundary. Existing/proposed utilities can be shown on the plat, but demo lines and hatch
should not be.
Response: Demo lines and hatch has been removed from the plat.
3. Label the utility easement from Fallon.
Response: A label for the utility easement for electrical service has added.
4. Label the document for the existing 10-foot-wide utility easement along the west side of Stafford
Avenue.
Response: The easement has been labeled.
5. The City strongly recommends the 60-foot Palisade Drive easement and the 60-foot Stafford Avenue
easement be dedicated as Right-of-Way.
Response: Palisade Drive and South Stafford Avenue are shown on the plat as dedicated
right-of-way.
6. Label Palisade Drive on the Plat.
Response: The label has been added.
7. Show the 10-foot utility easements on either side of Palisade Drive.
Response: the easements have been added.
8. BMC Section 38.410.080.D. Underground ADS Chamber System Chamber A in the parking lot
south of Building 17 will need to be located on its own lot owned and maintained by the HOA. The
lot should be labeled “Open Space __”.
Response: An open space tract has been added.
9. Underground ADS Chamber System C within the Palisade Drive right-of-way will require an
encroachment permit from the City.
Response: An encroachment permit was submitted to the City in April 2018. A copy of the
permit is attached to this application.
10. BMC Section 38.410.080.D. Underground ADS Chamber System D in the parking lot east of
Building 13 will need to be located on its own lot owned and maintained by the HOA. The lot
should be labeled “Open Space __”.
Response: An open space tract has been added.
11. Chamber E which retains the deficient volume from the Ferguson Farms subdivision to the south
requires an encroachment permit if it’s located within the Stafford Avenue ROW.
Response: Response: An encroachment permit was submitted to the City in April 2018. A
copy of the permit is attached to this application.
12. BMC Section 38.410.080.D. Chamber F in the southwest corner of the intersection of Stafford
Avenue and West Babcock Street will need to be located on its own lot owned and maintained by the
HOA. The lot should be labeled “Open Space __”.
Response: An open space tract has been added.
