Box 4735, Bozeman, MT 59772-4735, the GRANTOR, in consideration of one dollar ($ 1.00) and for other and valuable consideration, receipt of which is hereby acknowledged, grants to the City of Bozeman, a Municipal Corporation of the State of Montana, \vlthofficesat411 East Main, with a mailing address of P.O. Box 1230, Bozeman, Montana 59771-1230, the GRANTEE, a public access easement for a sidewalk for the use of the public in, through and across a 4.00 foot wide strip of land situated in Gallatin County, Montana, which is located on the following described property: Lot lAI, Block 4, AtvIENDED PLAT OF LOTS lA, 2, 3, & 4A OF BLOCK 4 OF WALKER PROPERTY SUBDIVISION, A PLANNED lJNIT DEVELOPMENT, City of Bozeman, accordmg to the plat thereof, on file and of record in the office of the Clerk and Recorder, Gallatin County, Montana; Said easement is a strip ofland 4.00 feet wide over and across said Lot 1 AI, and is more particularly shown on the attached Exhibit A, which by this reference are made a part hereof. The GRANTOR agrees: (I) To construct and maintain the sidewalk at their own expense III accordance with relevant City Ordinances, including, but not limited to, snow removal and all major and minor repair work. (2) TC' allow the CIty to make any a,.d all inspections of the side\'.. .1lk anJ land appunenant thereto as the City reasonably deems necessary. The GRANTOR warrants that they are lawfully seized and possessed of the real property described above, that they have a lawful right to convey the property, or any part of it, and that they will forever defend the title to this property against the claims of all persons. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTORS. The terms, covenants and provisions ofthis easement shall extend to and he binding upon the heirs, ex.ecutors, administrators, personal representattves, successors and assigns of the parties hereto.
