HomeMy WebLinkAboutResolution 3969 Bridger Creek Growth Policy Amendment RESOLUTION NO. 3969 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE GROWTH POLICY LAND USE DESIGNATION, AS SHOWN ON THE FUTURE LAND USE MAP IN THE BOZEMAN 2020 COMMUNITY PLAN, FROM NEIGHBORHOOD COMMERCIAL TO RESIDENTIAL FOR 7.11 ACRES, AS ALLOWED BY SECTION 76-1-604(3)(A), MONTANA CODE ANNOTATED (MCA) AND SECTION 2.4, BOZEMAN 2020 COMMUNITY PLAN. WHEREAS, the proposed growth policy amendment to amend the growth polley land use designation, as shown on the Future Land Use Map in the Bozeman 2020 Community Plan, from Neighborhood Commercial to Residential for 7.11 acres has been properly submitted, reviewed and advertised; and WHEREAS, the Bozeman Planning Board held a public hearing on September 6, 2006, to receive and review all written and oral testimony on the request for a growth policy amendment; and WHEREAS, the Bozeman Planning Board voted 4 in favor and 3 against to forward to the Bozeman City Commission an informal, unofficial recommendation of approval for said growth policy amendment; and WHEREAS, after proper notice, the City Commission held ItS public hearing on September 18, 2006, to receive and review all written and oral testimony on the request for a growth policy amendment; and WHEREAS, the City Commission has reviewed and considered the four growth policy amendment criteria established in Section 2.4.1 of the Bozeman 2020 Community Plan, and found that the growth policy amendment as proposed would be in compliance with the four criteria; and NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That upon a vote of 5-0, the growth pOlicy land use designation for the following-described properties is hereby designated as Residential: Lots 56, 57, and 58A of Bridger Creek Subdivision Phase I, situated in the SE1/4 Section 31, T1 S, R6E, P.M.M., City of Bozeman, Gallatin County, Montana, and being more particularly described as follows: Lot 56 Commencing at intersection of the south boundary of Bridger Creek Subdivision Phase 1 and the east right-of-way line of Birdie Drive, the True Point of Beginning; Thence along said east right-of-way line, N01 022'17"W a distance of 26.88 feet; Thence along a tangent curve to the left a distance of 50.89 feet, said curve having a radius of 330.00 feet and a central angle of 8050'06"; Thence N10012'23''W a distance of 230.60 feet; Thence along a tangent curve to the right a distance of 31.01 feet, said curve having a radius of 270.00 feet and a central angle of 6034'48"; Thence N03037'35"W a distance of 52.75 feet; Thence N86022'25"E a distance of 260.37 feet; Thence S35027'35"E a distance of 473.73 feet; Thence S8r48'37"W a distance of 481.35 feet to the Point of Beginning.
