WHEREAS, on March 13, 2020, the President of the United States issued a
Proclamation on Declaring a National Emergency Concerning the Novel Coronavirus
Disease (COVID-19) Outbreak; and
WHEREAS, on March 12, 2020, the Governor of the State of Montana issued
Executive Order No. 2-2020 Declaring a State of Emergency to Exist Within the State of
Montana Related to the Communicable Disease Covid-19 Novel Coronavirus; and
WHEREAS, the Health Officer and Board of Health for the Gallatin City-County
Health Department are implementing precautionary and protective measures for the
citizens of the City of Bozeman; and
WHEREAS, on March 16, 2020 the City Manager issued an Emergency Declaration
establishing certain authority and powers which such Declaration is incorporated herein;
and
WHEREAS, on March 16, 2020 the City Manager issued Order ED-02 cancelling
aquatic and recreation programs and cancelling City recreation and park facility use
permits until June, 2020 and ordering the City not accept new reservations for recreation
and park facilities until May 1, 2020; and
WHEREAS, on March 17, 2020 the Bozeman City Manager issued Order ED-03
cancelling all authorizations issued by the City for parade and public assembly permits

until June 1, 2020 and ordering new applications for the same not be accepted by the City
until May 1,2020; and
WHEREAS,on March 31,2020,.the City Manager issued Order ED-08 closing all City
playgrounds effective April 2, 2020 until further notice.
NOW,THEREFORE,as City Manager of the City of Bozeman,Montana, and as chief
executive officer of the City, and pursuant to the authority vested in me by the City of
Bozeman Charter and the laws of the State of Montana, I hereby issue this Order in
fulfillment of the Emergency Declaration dated March 16,2020.
As such, I order the following related to aquatic and recreation-programming, park and
recreation facility rentals,parade and public assemblies, and play rg ounds:
1. Recreation and Aquatics Programs: All City aquatic and recreation programs
may commence operations on May 18, 2020 pursuant to the City Manager's
adopted pandemic recovery plans as such may be amended.
2. Park and Recreation Facility Reservations:
a. All reservations and permits for use of City recreation and park facilities for
events scheduled prior to June 1, 2020 continue to be cancelled.
b. The City may begin accepting new reservations for use of City recreation
and park facilities on May 18, 2020 for events after June 1, 2020. Such
reservations may only be made if the request is in compliance with the
City's recovery plan, ongoing directives and guidance from the Governor
of the State of Montana, orders of the Gallatin City-County Health Officer,
and rules adopted by the Gallatin City-County Health Board.
c. As of the date of this Order,Montana remains in phase 1 of the Governor's
recovery plan. As such, beginning on May 18, 2020, the City may accept
reservations only for events that comply with all requirements of phase 1 of
the Governor's recovery plan and orders and rules of the Gallatin City-
County Health Department including limitations on group size of ten(10)
or less individuals. Because there is currently no date established for
transitioning from phase 1 to subsequent phases of the Governor's recovery
plan,the City will not currently accept for any date,reservations for events
that exceed the requirements of phase 1 of the Governor's recovery plan.
d. As the State of Montana moves from phase 1 of its recovery plan to
subsequent phases, the City may, beginning on the effective date of a
subsequent phase,accept reservations for events that are in compliance with

the requirements of each subsequent phase including increasing group size
for reservations occurring within phase 2.
e. The Director of Parks &Recreation must take all steps necessary to inform
permittees of this Order and issue refunds of all permit fees for
authorizations subject to this Order.
3. Parade and Public Assembly Permits:
a. All reservations and permits for parades and public assemblies scheduled
prior to June 1, 2020 continue to be cancelled.
b. The City may begin accepting new reservations for public assembly and
parade permits on May 18, 2020 for events scheduled after June 1, 2020.
Such reservations may only be made if the requested event is in compliance
with ongoing directives and guidance from the Governor of the State of
Montana, orders of the Gallatin City-County Health Officer and rules
adopted by the Gallatin City-County Health Board.
c. As of the date of this Order,Montana remains in phase 1 of the Governor's
recovery plan. As such, beginning on May 18, 2020, the City may accept
reservations only for parades and public assemblies that comply with all
requirements of phase 1 of the Governor's recovery plan and orders and
rules of the Gallatin City-County Health including limitations on group size
of ten(10)or less individuals.Because there is currently no date established

recovery plan, the City will not currently accept for any date, reservations

subsequent phase, accept reservations for parades and public assemblies
that are in compliance with the requirements of each subsequent phase
including increasing group size for reservations occurring within phase.
e. The Director of Public Works must take all steps necessary to inform
permittees of this Order and issue refunds of all permit fees for
authorizations subject to this Order.
4. Playground Closures: Order Ed-08 regarding the closure of playgrounds remains
in effect until phase 2 of the State of Montana's recovery plan. Upon the effective
date of phase 2, the order closing all City playgrounds will be automatically
withdrawn.

5. General:
a. This Order incorporates and is subject to all requirements of the City of
Bozeman's adopted recovery plan including any amendments.
b. This Order incorporates and is subject to all requirements of the Montana
Governor's Directive dated April 22, 2020 regarding "The Montana
Governor's Directive implementing Executive Orders 2-2020 and 3-2020
and providing guidance for the phased reopening of Montana and
establishing conditions for Phase One" including directives related to
progression between phases, guidance applicable to all phases, and
guidance for each phase.
c. This Order incorporates and is subject to any future directives of the
Governor of the State of Montana.
d. This Order incorporates and is subject to all existing and future orders of
the Gallatin City-County Health Officer and existing and future orders and
rules of the Gallatin City-County Board of Health including but not limited
to those related to gathering size, physical distancing and sanitation
requirements.
e. This Order will be in place until cancelled or superseded by subsequent
Order of the City Manager. If this Order is cancelled,the City may reinstate
park and recreation facility reservations and permits for parades and public
assemblies upon repayment of all required fees and compliance with all
requirements of the reservation or permit.
f. Repayment of fees may be waived by the Directors of Parks and Recreation
or Public Works.
g. This Order will be in place until cancelled or superseded by subsequent
Order of the City Manager. This Order expires automatically upon
revocation of the City's Declaration of Emergency.
h. The contents of this order must be posted on the City's website.
i. City departments must take all steps necessary to implement this Order.
