MEETING DATE: May 18, 2020 AGENDA ITEM TYPE: Consent RECOMMENDATION: That the City Commission approve the Final Plat for The Crossing II Phase 4G&4H Subdivision Final Plat; and authorize the Director of Public Works to execute the same on behalf of the City of Bozeman, and the Director of Community Development to execute the improvements agreement on behalf of the City of Bozeman. BACKGROUND: On May 6, 2013, the City Commission approved the findings of fact completing the preliminary plat approval to subdivide 36.94 acres together with the required supplementary plans and information to create three commercial lots and a park, and rights-of-way. Several prior phases have completed the final plat process. The developer has applied for final plat review and approval for the final two phases, 4G and 4H. The preliminary plat was approved by the City Commission on March 25, 2013. Staff has concluded that all terms and conditions of the preliminary plat approval have been met. An improvements agreement has been completed for the future installation of sidewalks on individual lots. The appropriate financial guarantees have been received. §76-3-611(1), MCA, provides that the City Commission shall approve the plat only if: (a) it conforms to the conditions of approval set forth on the preliminary plat and to the terms of this chapter and regulations adopted pursuant to this chapter; and (b) the county treasurer has certified that all real property taxes and special assessments assessed and levied on the land to be subdivided have been paid. Attached is a memorandum from Tom 109 Rogers, Senior Planner, stating the staff has concluded that all terms and conditions of the preliminary plat approval have been met. An Improvements Agreement is required for final plat approval of this subdivision. The improvements agreement guarantees the installation of public street lighting, park improvements, lot frontage sidewalks, and subdivision pathways. All other necessary infrastructure improvements are constructed. UNRESOLVED ISSUES: None. ALTERNATIVES: As proposed by the City Commission. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues from new development, along with increased costs to deliver municipal services to the property.
