Contract, Anderson Pavilion at Bogert Park Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Jon Henderson, Strategic Services Director SUBJECT: Setting the Guaranteed Maximum Price for Repair of the Anderson Pavilion at Bogert Park MEETING DATE: May 18, 2020 MEETING TYPE Consent RECOMMENDATION: Ratify the Interim City Manager’s signature on an Amendment to the Construction Contract for the Anderson Pavilion at Bogert Park Setting the Guaranteed Maximum Price. BACKGROUND: On July 15th, 2019 the City Commission directed staff to proceed with repair of the Anderson Pavilion at Bogert Park (formerly known as the Bogert Pavilion) following a partial roof collapse that occurred on March 17th, 2019. Martel Construction was selected through a competitive RFQ / RFP process and awarded a Construction Contract for General Contractor / Construction Manager services on November 4th, 2019. The contract relies on a Guaranteed Maximum Price (GMP) to ensure total costs fit within the allowable budget. Formal bids for the project were received on April 17th, 2020 following an extensive design process intended to provide the highest level of safety and longevity, in addition to construction standards needed to comply with current building codes. This Amendment sets the Guaranteed Maximum Price (GMP) for the construction phase of the project not exceed $696,714. The Base Bid of $440,704 comprises all general requirements and existing conditions, including electrical work and minor site improvements (among other related services). Alternate #1 includes full replacement of the roof membrane for $202,378, necessary to maintain the integrity of the overall roof system among all areas of the repair. Alternate #3 includes LED lighting upgrades for $13,310 to replace aging and inefficient fixtures. Other work includes $10,352 for pre- construction services and $29,970 for winter stabilization efforts including the installation of a support system to prevent further collapse. The attached amendment has been reviewed by the Legal Department and signed by the City Manager to expedite long-lead material orders without negatively impacting the project schedule. Substantial completion is anticipated by September 18th, 2020. Efforts will be made to minimize disruption in the adjacent park area, while the Pavilion remains closed to the public. 85 UNRESOLVED ISSUES: None. FISCAL EFFECTS: On June 24th, 2019 the City Commission allocated $200,000 to the project as part of Resolution No. 5048 adopting a final budget for FY20. An additional $209,507 was allocated on September 9th, 2019 as part of Resolution No. 5068 setting mill levies for FY20. On October 21st, 2019 the City Commission accepted a donation of $350,000 in exchange for naming rights (“The Anderson Pavilion at Bogert Park”), bringing the total budget to $759,507. $51,626 has been spent to date for structural assessments, security fencing, and other expenses related to the initial response. Negotiations with MMIA are ongoing as part of an insurance claim to determine the appropriate reimbursement for damage related to the collapse. Any remaining balance upon project completion will go back to the General Fund. ALTERNATIVES: As suggested by the City Commission. After bids were received, a GMP (Guaranteed Maximum Price) was assembled for the project. This GMP includes all the work shown on the contract documents. The attached GMP Summary is taken from the drawings and other information provided by the Design Team. Project Description The project consists of repairs and upgrades for the Bogert Pavilion located in Bogert Park. The scope of the work is defined by the project plans, specifications and addenda used to determine the Guaranteed Maximum Cost. Briefly Described as: a. Approximate Square Footage: ~30,000 gross square feet. b. Location: Bogert Park, 325 S Church Ave, Bozeman, MT c. Occupancy: Assembly Group A-5 GMP - Summary of Cost Pre-Construction Services $10,352 Early Work Amendment #1 $29,970 Construction Services Amendment #2 Base Bid $440,704 Alternate #1 – Complete Reroof $202,378 Alternate #2 – New LED Lighting $13,310 Total GMP $696,714 89 SECTION TWO Notes and Assumptions Concerning the Budget General This Presentation and the Notes and Assumptions Concerning the Proposals and are prepared for the purpose of providing information to the City of Bozeman to guide their decisions on the proposed work. Pricing – The Current pricing is based on the information from Martel Construction and from public bidding results. Total estimated value includes the following costs: · Performance and Payment Bond · General Liability Insurance · GC/CM Fee per Contract · Gross Receipts Tax · Builders Risk Insurance · Alternates as depicted in the attachment · Construction Contingency We are not carrying costs in our construction estimate for: · Plan Review Fees, Building Permits or Impact Fees · Escalation · Third Party Testing & Inspections and Special Inspections · Commissioning · Northwest Energy Costs · Other Utility Company Costs · Hazardous Material Abatement of any kind. · Moving Expenses of Owner Items General Conditions for the project are based on a project duration totaling 10 weeks without shutdown.
