HomeMy WebLinkAboutConsent 3 Commission Memorandum REPORT TO: Mayor and City Commission FROM: Brian Krueger, Development Review Manager SUBJECT: Authorize the Public Works Director to Accept Dedications for Public Street, Access, and Utility Easements as Shown on the Certificate of Survey for State of Montana Owned Land for the North Park Master Site Plan, Application Z15273 MEETING DATE: May 4, 2020 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the Public Works Director to accept dedications for public street, access, and utility easements as shown on the certificate of survey for State of Montana owned land at the North Park Development in order to comply with conditions of approval. BACKGROUND: On September 8, 2015, the Director of Community Development granted conditional preliminary approval to the North Park Master Site Plan on property generally located north of Mandeville Lane, south of Redwing Drive and west of Flora Lane near the vicinity of North 7th Avenue and Mandeville Lane/Griffin Drive consisting of approximately 175 acres. The master plan approval was for a primary development layout and infrastructure design. A final plan application was required and was submitted on April 27, 2017. Review of that plan has been ongoing. Conditions of approval are required to be satisfied in the final plan prior to final approval. Multiple conditions of approval related to right of way dedication, public utility easements, stormwater easements, and public access easements for a trail are satisfied with the approval and recordation of the attached Certificate of Survey. Staff has reviewed the easements and find them in the required locations and in the appropriate form. The Director of Public Works is the designated authority to accept dedications on behalf of the City with City Commission approval. UNRESOLVED ISSUES: Staff is unaware of any unresolved issues. ALTERNATIVES: 1) Authorize the Public Works Director to accept the dedications. 2) Authorize the Public Works Director to accept the dedications with modifications. 3) As determined by the City Commission. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues from new development, along with increased costs to deliver municipal services to the property. Impact fees will be collected at the time of issuance of building permits for individual lots along with City sewer and water connection fees.
