SUBJECT: Authorize the Interim City Manager to Sign Notice of Award to Knife River - Belgrade and Final Contract Documents Once Received Pending Legal Review

RECOMMENDATION: Authorize the Interim City Manager to Sign the Notice of Award to Treasure State Inc. for the total Base Bid of $1,845,761.05, and final contract documents once received pending legal review.
BACKGROUND: The Aspen Street and 5th Avenue Improvements Project integrates several sets of improvements that were designated in the Midtown Urban Renewal Plan (2015) and the Midtown Action Plan (2017). These projects include the installation of enhanced streetscape elements on W. Aspen St. to create a “festival street”, back-in angle parking at the Westlake BMX Park, and a multi-use path in the N. 5th Avenue right-of-way between Tamarack Street and Oak Street. The bid was advertised in March 2020 and extended into April 2020 to facilitate addendums and process changes related to conducting a remote bid opening. Bids were opened on April 7, 2020 with three bids submitted. The low bid was submitted by Knife River – Belgrade for the Total Base Bid of $1,845,761.05. This amount is lower than the engineer’s estimate of probable cost for the project.
UNRESOLVED ISSUES:
Staff expects change orders for this project. The first proposed change order will be related to the elimination of a drive approach for the Audrey’s Pizza site. As part of an agreement with the property owner, the City agreed to make infrastructure improvements to the property. These improvements are under engineering review.

FISCAL EFFECTS: Funding for this project relies on issuing urban renewal revenue bonds against the revenue of the Midtown Urban Renewal District Tax Increment Fund. While the City Commission has already authorized the administration to move forward with the bonding process, the process is not finalized.

The Contract Price of your Contract is One Million, Eight Hundred Forty-Five Thousand, Seven
Hundred and Sixty-One and 05/100 Dollars ($1,845,761.05).
Four (4) copies of the proposed Contract Documents (except Drawings) accompany this Notice of Award.
Two (2) sets of the Drawings will be delivered separately or otherwise made available to you immediately.
You must comply with the following conditions precedent within [15] days of the date you receive this
Notice of Award.
1. Deliver to the Owner Four (4) fully executed counterparts of the Contract Documents.
2. Deliver with the executed Contract Documents the Contract security [Bonds] as specified in the
Instructions to Bidders (Article 20), General Conditions (Paragraph 5.01), and Supplementary
Conditions (Paragraph SC-5.01).
3. Other conditions precedent:
Deliver with the executed Contract Documents the required insurance certificates.
Failure to comply with these conditions within the time specified will entitle Owner to consider you in
default, annul this Notice of Award, and declare your Bid security forfeited.
Within ten days after you comply with the above conditions, Owner will return to you one fully executed
counterpart of the Contract Documents.

Several discrepancies were noted during our review of the bid from CK May Excavating, Inc. These
discrepancies have been corrected with the unit price prevailing and the total bid for Schedule II has
been adjusted per Article 14, Section 00200 of Montana Public Works Standard Specifications, 6th
Edition. Based on this review, Sanderson Stewart recommends that the City of Bozeman move
forward with a contract award to Knife River - Belgrade in the amount of $1,845,761.05. Attached
are copies of the bid tabulation and the signed bid documents from all three contractors.
