As you know, I live on N Grand, directly across the alley from thecommercial building project on the 400 block of N. Willson. For the past few weeks a bass thumping noise frommusic at the site has been almost daily, Monday-Saturday (and sometimes Sunday), and for long days (from dawnuntil about 7pm). I have made multiple calls to both site manager Kaleb Hanson (406-839-3960) and the BozemanPolice Department (BPD). * Kaleb responded that the crew had been asked not to play music at all. Obviously this is not being abided by. * The BPD gave their opinion that the music is not excessive in volume. However, thumping bass is audibleinside my home, with windows and doors closed, and storm windows on (double pane). * The BPD gave their reading of the law which is noise is allowed from dawn until 8pm at night, daily. While Iunderstand we must endure the construction noise (and, this project has been running a long time), music noise(unless one has chosen to live over a bar or so) for 12+ hours/day, daily, is EXCESSIVE in duration and preventsthe peaceful enjoyment of one’s residence. * I have requested that the crew use a boom box without bass or bass boost. Not even to cut the music completely,but the bass, which seems to be the invasive part. This seems like reasonable accommodation, or, middle ground. As it happens, I have need of reasonable accommodation for having some physiological reactions to such ongoingnoise stress. And, it does not seem like anyone, having chosen to live in a quiet, residential neighborhood, whowould like to enjoy early spring including bird song, should need to endure bass as if an errant car is in the drivewith the bass boost on, for others’ commercial gain. If there is any way to negotiate this matter, I think a reasonable accommodation has been offered and is not beingupheld, despite promises. Thank you, Kris Keller
