Minutes - January 18, 2000, November 22, 2002, and April 7, 2003 4. Consent Items - a. Ordinance No. 1593 - establishing initial municipal zoning designations of "R-2," "R-3A" and "R-3" on 59.03 acres located in the NW}4 and SW}4, Section 35, T1 S, R5E, MPM (Cattail Creek Subdivision, Phase II); finally adopt (Previously Item 4e on March 31 agenda) b. Commission Resolution No. 3587 - intent to establish a 2003 Sidewalk Program; set public hearing for May 5, 2003 c. Commission Resolution No. 3588 - authorize City Managerto sign Change Order NO.2 for Wastewater Treatment Plant modifications - Williams Plumbing and Heating, Inc., Bozeman Montana - deduct $1,511.80 and add 1 calendar day d. Acknowledge receipt of staff report - request from Montana Association of Seventh Day Adventists for annexation of 9.036-acre parcel lying between Haggerty Lane and 1-90 at Ellis Street extended (A-03001) (LW) e. Commission Resolution No. 3589 - intent to annex 9.036-acre parcel lying between Haggerty Lane and 1-90 at Ellis Street extended; set public hearing for May 12, 2003 f. Ordinance No. 1594 - adding Chapter 2.98 to the Bozeman Municipal Code, providing for creation of the Bozeman Area Bicycle Advisory Board; provisionally adopt and bring back in two weeks for final adoption g. Ordinance No. 1595 - zone code amendment - Section 18.16.060 of the Bozeman Municipal Code, modifying building height restrictions in "R-2" zoning district; provisionally adopt and bring back in two weeks for final adoption h. Appoint Commissioner Hietala and Commissioner Brown to sub-committee to review Pledged Securities as of March 31,2003 i. Claims Motion and vote to approve, and authorize and direct the appropriate persons to complete the necessary actions 5. Ratify City Manager's signature on buy/sell agreement for SAE House Possible motion and vote (if agreement is reached by Commission meeting time) 6. Public hearing - Major Site Plan with Certificate of Appropriateness - Springer Group Architects for David MacDonald - allow construction of two multi-tenant retail buildings, one containing :t3,500 square feet and one containing :t5,700 square feet, on Lot 8, StoneRidge PUD Major Subdivision, Phase II (southwest corner of intersection of North 22nd Avenue and North 19th Avenue) (Z-03035) (JM) Conduct public hearing; motion and vote (to or not to approve) 13. Public hearing - Minor Site Plan with Certificate of Appropriateness - Apogee Architects for Rich Daem - allow construction of 9,845-square-foot bank establishment on Lot 22, StoneRidge PUD Minor Subdivision, Phase liB, with deviation from Section 18.28.050, Bozeman Municipal Code, to allow parking lot to encroach 5 feet into the required 25- foot front yard setback (Z-03034) (CH) Conduct public hearing; motion and vote (to or not to approve) 14. Public review - preliminary plat for first minor subdivision - subdivide property described as the east 77 feet of Lots 1-6, Block 16, Park Addition, into two lots - C&H Engineering for Melissa and Dennis Steinhauer, 404 West Curtiss Street (P-03006) (SK) Open and continue review to April 21 to give City Planning Board opportunity to forward recommendation 15. Continued public hearing - Certificate of Appropriateness to allow construction of 515- square-foot shed on Lots 7, 8, 9 and 10, Block 15, Capitol Hill Addition, with deviations from Section 18.18.050, Bozeman Municipal Code, to allow proposed shed to encroach 15~ feet into required 20-foot rear yard setback and 4 feet into required 5-foot side yard setback; and from Section 18.50.050, to allow accessory structure to occupy more than 25 percent of the required rear yard - Scott Lawson, 405 West Cleveland Street (Z- 03021) (SK) (Previously Item 13 on February 24 agenda and Item 12 on March 10 agenda) Conduct continued public hearing; motion and vote (to or not to approve) 16.
