MEETING DATE: March 23, 2020 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the Interim City Manager to Sign the Notice of Award to Treasure State Inc. for the total Base Bid of $3,495,000, and final contract documents once received pending legal review. BACKGROUND: The N. 7th Ave. Streetscape Project is the flagship project of the Midtown Urban Renewal District with the goal of improving pedestrian safety and connectivity while improving street lighting and the aesthetics of the corridor. The bid was advertised in January 2020 and extended into February 2020 to facilitate more time for interested bidders to respond. Bids were opened on February 20, 2020 with two bids submitted. The low bid was submitted by Treasure State Inc. – Belgrade for the Total Base Bid of $3,495,000. This amount is lower than the engineer’s estimate of probable cost for the project. UNRESOLVED ISSUES: In a few instances, engineers were forced to design around properties where the owners did not provide right-of-way for the project. Negotiations for right-of-way with some of these property owners is ongoing. Success in these negotiations will prompt change orders for this project. FISCAL EFFECTS: Funding for this project relies on issuing urban renewal revenue bonds against the revenue of the Midtown Urban Renewal District Tax Increment Fund. While the City Commission has already authorized the administration to move

forward with the bonding process, the process is not finalized. An agreement with Stifel Nicolaus and Company to serve as Placement Agent is also included as a Consent Item on this agenda to advance the bonding process.

Successful Bidder and are awarded a Contract for Schedules I, II and III.
The Contract Price of your Contract is Three Million Four Hundred Ninety Five Thousand and 00/100 Dollars
($3,495,000.00).
5 copies of each of the proposed Contract Documents (except Drawings) accompany this Notice of Award.
2 sets of the Drawings will be delivered separately or otherwise made available to you immediately.
You must comply with the following conditions precedent within fifteen days of the date you receive this Notice of
Award.
1. Deliver to the Owner [5] fully executed counterparts of the Contract Documents.
2. Deliver with the executed Contract Documents the Contract security [Bonds] as specified in the
Instructions to Bidders (Article 20), [and] General Conditions (Paragraphs 2.01 and 5.01) [and
Supplementary Conditions (Paragraph SC-2.01).]
3. Other conditions precedent:
Failure to comply with these conditions within the time specified will entitle Owner to consider you in default,
annul this Notice of Award and declare your Bid security forfeited.
Within fifteen days after you comply with the above conditions, Owner will return to you two fully executed
counterparts of the Contract Documents.
