THIRD AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT THIS D-AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT FOR CAPITAL IMPROVEMENT PROJECTS FIELD SURVEY, dated June 181", 2018 (the "Agreement") is made and entered into this � day of , 2020, by and between the CITY OF BOZEMAN, MONTANA, a self governing municipal corporation organized and existing under its Charter and the laws of the State of Montana, 121 North Rouse Street, Bozeman, Montana,with a mailing address of PO Box 1230, Bozeman, MT 59771, hereinafter referred to as "City," and MORRISON-MAIERLE, hereinafter referred to as "Contractor." In consideration of the mutual covenants and agreements herein contained, the receipt and sufficiency whereof being hereby acknowledged, the parties hereto agree to amend the Agreement as follows: 1. Addition to Scope of Work. Task 1000—Oconnell Drive has been added to the scope of services. This task shall be completed using traditional survey methods and delivered to the City of Bozeman during February 2020, pending weather. See Figure F. 2. Addition to Payment. See Exhibit 1000 and Summary—Fee Estimate attached. 3. Agreement still valid. We do have some additional questions for you. 1-Do you need the Oconnell ROW depicted on the survey?I think it would be beneficial to have the ROW shown but it doesn't need to be exact I just need a good idea of the ROW limits.What about properties adjacent to the survey area?Not necessary 2-Are there easements on the private property that allay access for the surveyors?No,but you should only need to access city ROW and the two parcels west of Oconnell.We are doing this work to appease the property owner who owns these two parcels and uses Oconnell Drive as a driveway access.Kyle has been in contact with him about the upcoming survey work. 3.Are you working with a property owner(s)on this project?Yes,we have spoken whh the property owner several times. 4. specific you have spec control point needs for construction?No 5.What is your general design plan so we can ensure we are tailoring the survey to meet your needs?Our rough plan Is to create additional storage rapacity In the detention pond,grade and pave Oconnell Drive,install a concrete valley gutter from the daylight point of the storm pond outlet pipe down the hill to the roadside ditch on S Church,and regrade the road side ditch the north to the culvert that crosses S Church 6.We are assuming that all the water,sewer and storm infrastructure shown below will need to by surveyed?Yes,please survey the utilities Gray Baserri 2018 Aerial 2018 Aerial 0 5O0 100ft
