published Friday,Jan 31, and action is to be taken on Monday, Feb 3. Gives the appearance that the City
is trying to take action without the public's knowledge.
Commission Memorandum (p. 157) says there will be a minimum of at least 30 days public notice prior
to any final action with regard to action on a PBZ. Ordinance (p 162 and 163) gives 15 days' notice of
"public hearing" and allows action at the conclusion on the "public hearing".
The issue of whether to allow one residential permit per dwelling; OR one residential permit per driver
residing in the PBZ is not resolved and should be before the ordinance is presented for first reading.
The ordinance gives absolute power to the Parking Commission to establish, amend or dissolve a PBZ
(Sec.. 36.04.603). There is no avenue for the public to initiate such action. The Public Engagement
Sessions recommended 60%approval of property owners within a PBZ. Also, p 169, item I b speaks of a
petition signE!d by 60%of property owners within a proposed PBZ in the Downtown Parking
Management District can initiate a process to create, modify... Again, this is not in the ordinance.
On p 164, Section 36.04.603 J the ordinance says the City Commission "may" authorize a portion, or all,
of any surplus... The wording should be "shall".
Finally, I support Sec. 36.04.604 F which states "Drivers residing in dwellings designated as
apartments..." are not eligible for resident permits. Also item G addressing the same issue for"visitor
permits".?ZA
