Several students from the Middle East who are currently visiting Bozeman and MSU introduced
themselves and notcd to the Commission the hospitality and friendliness of the local citizens and
thanked the Commission for allowing them the opportunity to address the local civic body.

CODE PROVISIONS:
a) Scction 18.34.130 reQuires the applicant to submit seven (7) copies a Final
Site Plan within six (6) months of preliminary approval containin2 all of the
conditions, corrections and modifications to be reviewed and approved by
thc Planninl! Office.
b) Section 18.42.150 reQuircs a Iig:htinl! plan. includinl! cut sheets. for any
proposed on-site 1i2htinl!.
c) Chapter 18.46 "Parking:," reQuires parking: lots to be paved with stripinl!,
curb and 2utter.
d) Disabled accessible spaces are subiect to the reQuirements of Section
18.46.040.D.
e) Section 18.46.040.E states that all developments shall provide adeQuate
bicycle parkinl! facilities to accommodate residents and l!uests. The location
and details for the bike rack shall be provided in the Final Site Plan.

f) Chaptcr 18.48 requires yard and parkinl! lot landscapin2.
g) The }<"inal Site Plan shall be adequately dimensioned. A complete leg:end of
all line types used shall also be provided.
h) A Storm Water Draina!!e/Treatment Gradinl! Plan and Maintcnancc Plan
for a system dcsiened to removc solids. silt. oils, ercasc. and othcr pollutants
must be provided to and approved by the City Emdneer. The plan must

m) The drive approach shall be constructed in accordance with the City's
standard approach (Le., concrete apron, sidewalk section and drop-curb)
and shown as such on the Final Site Plan. A City Curb Cut and Sidewalk
Permit shall be obtained prior to Final Site Plan approval.
n) City standard sidewalk shall bc installcd and propcrly depicted at the
standard location (Le., 1 foot off property line) along: the street(s) frontal!e.
Any deviation to the standard alil!nment or location must be approved by
the City Enj!ineer.
0) Typical curb details (i.e., raised and/or drop curbs) and typical asphalt
paving: section detail shall be provided to and approved by the City

materials and heavy equipment will travel to and from the site in

thc responsibility of the applicant to ensure that thc construction
traffic follows thc approvcd routes.
q) All construction activities shall comply with section 18.74.020.A.2 of the
Unified Development Ordinance. This shall include routine

may reauire a g:uarantee as allowed for under this section at any time

TERMS OF ANNEXATION:
1) That the applicant exccutc at thc Gallatin County Clerk & Recorder's Office a waiver
of ril!ht-to-protest creation of S.I.D.'s for a City-wide Park Maintenance District,
which would provide a mechanism for the fair and eQuitable assessment of
maintenance costs for City parks as part of the Annexation Al!reement.
2) That provisions for water ri2hts or cash in-lieu of water ri2hts in an amount
determined by the Director of Public Service be providcd in the Annexation
Ag:reement whereby it is exccuted by the land owncr prior to final subdivision plat
approval, final site plan approval, or issuance of any building: permits, whichever
occurs first, prior to the City Commission adoptinl! the Resolution of Annexation and
acceptinl! the Annexation Ag:reement.
3) The land owners and their successors shall pay all fire and street impact fees for
existin2 development at time of annexation or remove the existing: home: water and
sewer impact fees at the time of connection: and for future developmcnt as requircd by
Chaptcr 3.24, Bozeman Municipal Code, or as amended at the time of application for
any permit listed therein.
4) An Annexation Map, titled "Mandeville Creek Annexation Map" with a leeal
description of the property and adioinin2 un annexed rig:hts-of-way and/or street
access casements shall be submitted by the applicant for use with the Annexation
Ag:reement. The map must be supplied on a mylar for City records (18" by 24"), a
reduced 8 Yz" x 11" or 8 Yi" by 14" exhibit for filing: with the Annexation Al!reement
at the County Clerk & Recorder, and a dieital copy for the City En2inecr's Officc.

This map must be acccptable to thc Dircctor of Public Scrvices and City Enl!ineer's

5) That the applicant executes all contim~:encies and terms of said Annexation A2reement

Commission. If the annexation is not approved, the application shall be null and void.
2. That the applicant submit a zone amendment map, titled "Mandeville Creek Zone
Map Amendment", on a 24" by 36" mylar, 8 Yz" by 11", or 8 Yz" by 14" paper exhibit.
and a dig:ital COpy of the area to be zoned. acceptable to the Director of Public Service,
which will be utilized in the preparation of the Ordinance to officially amend the City
of Bozeman Zoninl! Map. Said map shall contain a metes and bounds leg:al description

preparation of the Ordinance to officially amend the zone map.

CONDITIONS:
1. The applicant shall provide documentation that the proposed facility cannot be
accommodated on an existing structure or by placement of a smaller facility. In order
to justify the construction of a large-scale wireless facility. the applicant must
demonstrate that higher ranking alternatives. as outlined in UDO Section 18.54.040.B.2.
do not constitute feasible alternatives.
2. The applicant shall provide written factual documentation that the critical need exists
for a telecommunication tower at the proposed location. This submittal shall meet the
minimum standards set forth in UDO Section 18.54.040.g.
3. The applicant shall provide documentation to the City from the FAA and FCC
regarding the required hazard markings. if any. If no hazard marking is required then
the tower shall be constructed and finished as conditioned by staff.
4. A private utility easement shall be filed with the Clerk and Recorders Office for the area
of the proposed monopole and equipment building-so The site plan for Final Site Plan
submittal shall clearly depict this area as an "easement" rather than "lease." Evidence
of this shall be provided to the Planning Office prior to Final Site Plan approval.
5. To aid in screening. additional trees shall be installed along the south and eastern
perimeters of the proposed equipment. These trees shall be accurately depicted on the
Landscape plan for Final Site Plan submittal.
6. AU utility lines and casements shall be accurately depiCted on the Final Site Plan and
Landscape plan. Proposed extensions and additions shall be labeled "proposed."
7. The proposed mechanical equipment building shall be constructed and finished to
match that of the Bozeman Daily Chronicle building as closely as possible.
8. The proposed project shall be completed as approved and conditioned in the

18. Stormwater MasterPlan:
A Stormwater Master Plan for the subdivision for a system desig:ned to remove solids, silt,
oils, l!rease and other pollutants from the runoff from the private and public streets and
all lots must be provided to and approved by the City Eng:ineer.
The master plan must depict the maximum sized retention basin location, show location of
and provide easements for adeQuate draina2e ways within the subdivision to transport
runoff to the storm water receiving: channel. The plan shall include sufficient site g:radinl!
and elevation information (particularly for the basin site, drainal!e ways and finished lot
g:rades), typical storm water detention/retention basin and discharl!e structure details,
basin sizinl! calculations and a stormwater maintenance plan.
Any stormwater ponds located within a park or open space shall be desi2ned and
constructed to be conducive to the normal use and maintenance of the open space.
Stormwater ponds for runoff l!enerated by the subdivision (e.g:., g:enerallot runoff, public
or private streets, common open space, parks, etc.) shall not be located on easements
within privatelv owned lots.
While the runoff from the individual lots will be dependent on the intensity of use on each
lot, the maximum sizinl! of the storm retention facilities for each lot will be established
based on maximum site development. Final facility sizin2 may be reviewed and reduced
durinl! desig:n review of the FSP for each lot.
19. Plans and specifications and a detailed desig:n report for water and sewer main extensions,
storm sewer and the public street, prepared by a Professional Enl!ineer, shall be provided
to and approved by the City Eng:ineer and the Montana Department of Environmental
Quality. The Applicant shall also provide Professional Enl!ineerin2 services for
construction inspection, post-construction certification, and preparation of mylar record
drawinl!s. Construction shall not be initiated on the public infrastructure improvements
until the plans and specifications have been approved and a pre-construction conference
has been conducted.
No buildinl! permits shall be issued prior to substantial completion and City acceptance of
the reQuired infrastructure improvements.

City standard residential sidewalks shall be constructed on all public street fronta2es of a

anniversary of the plat recordation of any phase of the subdivision. any lot owner who has
not constructed said sidewalk shall, without further notice. construct within 30 days said
sidewalk for their lot(s). re2ardless of whether other improvements have been made upon
the lot. This condition shall be induded on the final plat for the suhdivision.
21. The location of existinl! water and sewer mains shall he properly depicted. Proposed main
extensions shall be noted as proposed.
22. The Montana Fish. Wildlife and Parks, SCS, Montana Department of Environmental
Quality and Armv Corps of .Enl!ineer's shall be contacted re2ardin2 the proposed project

23. Ditch relocation:

24. Easements for the water and sewer main extensions shall be a minimum of 30 feet in
width, with the utility located in the center of the easement. In no case shall the utility be

28. All construction activities shall comply with section 18.74.020.A.2. of the Unified
Development Ordinance. This shall include routine cleaninl!/sweepinl! of material that is
dral!l!ed to adjacent streets. The City may require a 2uarantee as allowed for under this

reQuired are complete. The developer shall be responsible to reimburse the City for all

for the intersection shall be installed with the proiect.

4:26: 16 FYI - Mayor Krauss
Mayor Krauss noted the change in venue on July 24th to the City Commission Meeting Room in
City Hall. Also Mayor Krauss stated that he would bc absent at the July 31, 2006 Commission
meeting. Additionally, he had qucstions about the TlF on Mandeville Farm.

Mr. Kukulski thanked the Commission for extending the meeting in order to conclude business and
noted that the length of the meeting was due to extenuating circumstances.

Mr. Epple updated the Commission on the Anderson situation and noted that a solution had been
reached.

Commissioner Becker mentioned the watershed tour and his meeting with Rick Hixson regarding
