Olive St. Bozeman, MT 59715 Re: Blackmore Bend Marketplace Building Site Plan Application Dear Dr. Woolard: Please consider this letter a formal request for waiver of the intersection Level of Service (LOS) requirements for the intersection of Highland Blvd. and E. Main St. The Owner, East Main Investments, LLC, recognizes that the proper upgrade of this intersection will be necessary in order to adequately function with development of the subject property, as well as, with future development along the Highland Blvd. corridor. We have previously met with you and staff to discuss the preliminary design and cost share for the intersection upgrade. Additionally, we have met with MDT to discuss the preliminary design and gained their conceptual approval of the preliminary design. This request is being made to waive the LOS requirement for site plan approval of the Phase 1 Marketplace Building Site Plan only. However, we are proceeding with design and plan production for the intersection upgrade, and the intent is to apply for concurrent construction and begin construction of the Highland Blvd. and E. Main St. intersection as soon as approval and permits are granted from MDT. This waiver request meets the requirements of BMC 38.24.060.B.4.b. as follows: 1. There are no adverse impacts to public health and safety anticipated by granting a waiver for the intersection LOS requirement for the Phase 1 Marketplace Building; however, construction of the intersection upgrade will commence as soon as MDT approval is granted. 2. The upgrade of Highland, from E. Main to Kagy, is budgeted for in the most recently adopted transportation capital improvement plan but not yet scheduled. However, it is our understanding that the City has allocated funds for a portion of the construction cost for the E. Main and Highland intersection upgrade, the remainder of which will be split among East Main Investments, LLC and Bridger View Development, LLC, who is developing a site along E. Main St, just west of the intersection. 3. A Public Street and Utility Easement for the southwest corner of the intersection is being acquired for the necessary property needed to construct the intersection upgrade.     Page 2 of 2  4. The cost for construction of the E. Main and Highland intersection upgrade will be shared among the City, East Main Investments, LLC and Bridger View Development, LLC. It is our understanding that the City’s portion of this shared cost has already been approved and budgeted. Thank you in advance for your consideration of this requested LOS waiver.
