Cottonwood St Suite A Bozeman, MT 59715 RE: Blackmore Bend Subdivision Exemption Application 17165 Dear Mr. Springer, The above-referenced subdivision exemption amended plat appears to be acceptable for review with the following corrections: 1) Change the title to "Amended Plat of the Elks Club Property Subdivision..." 2) Please correct the legal description in the Certificate of Consent. The point of beginning cannot be within the Blackmore Bend Subdivision and must be tied to the plat that is being amended, Elks Club Subdivision. 3) Please correct the Certificate of Governing Body to say"Community Development Director." 4) Remove the Certification of completion of Improvements; no publically dedicated improvements are being made. 5) Remove the Certificate of Director of Public Works; no publically dedicated improvements are being made. 6) Please correct the Certificate of Exemption to reference MCA Code 76-3- 207(1)(d). This is a boundary relocation of five or fewer lots with in a platted subdivision. 7) Please correct the Certificate of Exclusion from Montana DEQ Review to reference MCA Code 76-4-125(2)(d). 8) Although it does not need to be a part of this plat, a shared access easement or agreement for shared drive aisles and shared parking will need to be executed. 9) Regarding the easements, please make the following changes: a. Remove the word "proposed" from all easements.Add the description "Public Utility Easements, see document " b. Standard public utility easement forms need to be submitted to the Engineering Division for review. • • TDD: 406-582-2301 THE MOST LIVABLE PLACE BOZE MAN MT Planning c. A 15-foot wide public right-of-way easement for Haggerty Lane in Lot 1 is indicated; however,that easement is also required where lot 4 is adjacent to Haggerty Lane. d. The 10-foot wide public utility easement indicated needs to extend along the north side of Lots 1 and 2, along Main Street,and connect with the 10-foot wide public utility easement to the east of lot 1. We will need to receive an updated electronic copy of the amended plat, two (2) full sized and one (1) 11X17 paper copies for review prior to mylars.
