I live on the north side of Mendenhall, directly across from the proposed ETHA hotel at 5 West Mendenhall.
I oppose the proposed modifications to the approved plans, specifically the relocation of the pool from the third
level to the 9th floor and installation of a screened in mechanical units in its place. It would seem as though the
developer has completely disregarded the approval process as well as department approvals and time frames.
As a lay person, it's very difficult to comprehend the scope, nuances and impact of all of the proposed changes, but
the pool and mechanical equipment swap stood out as noticeably egregious. The developer has already greatly
benefitted through the approval of three deviations to the Municipal Code which will result in the tallest and most
massive building in Bozeman.
The untimely request for modifications to the approved plan may further benefit the applicant, but such disregard to
following the outlined procedure will negatively impact adjacent properties, not to mention compromise the
legitimacy and enforceability of the Municipal Code and application procedure with future applicants.
We relied on the Approved plan when we purchased our home at 5 West. We could not imagine that the iconic
BAXTER Hotel marquee would completely disappear from view as a result of the construction, but we have to live
with it.
I understand and accept that “change” accompanies progress, however, I believe that the applicant should abide by
the approved plan and not presume that their modification proposal will benefit all parties equally and not
additionally impact the neighbors by hijacking the Municipal Code application and modification procedure.
I wish the ETHA owners and applicant success and do hope and anticipate that the Hotel will be a thriving success
and amenity for Bozeman.
We reply on the DRB and Planning department to fully vet these applications and modifications to protect the public
interest and keep Bozeman the most livable place.
