Olive St., Bozeman, MT 59715 Staff Report Bozeman Public Safety Center Site Plan Review Application: 19528 February 20, 2020 Page 2 of 14 PROJECT SUMMARY The City of Bozeman proposes the construction of a public safety center on a vacant parcel in the North Rouse Avenue corridor at the southwest corner of East Oak Street and North Rouse Avenue. The center will include offices, municipal courts, a police station, and a fire station including accessory uses, buildings, and site improvements. The primary accesses to the site are from East Tamarack Street, North Rouse Avenue, and East Oak Street. There are two public parking areas accessed from the north and south sides of the site. A continuous through north/south drive is accessible only to public safety personnel. The north/south drive provides access to the rear of the Bozeman Fire Station #1 and to a secure parking and service area for the facility, which includes Bozeman Police Department parking. The City completed an informal review for this project in September of 2019. The City did not request any agency exemptions to zoning requirements as is allowed in MCA Section 76-2-402. No departures are proposed. Pursuant to BMC 38.340.020, the Design Review Board (DRB) is the design review authority for development applications that meet certain thresholds. This project meets the required thresholds in BMC 38.230.040.C. The DRB is required to make a recommendation to the Director of Community Development on this application. The Design Review Board meeting will occur at 121 North Rouse Avenue, Bozeman MT, in the City Commission room at 5:30 p.m. on February 26, 2020. The Director of Community Development will make the final decision on this application after the review meeting and following the close of the public comment period. CONDITIONS OF APPROVAL Please note that these conditions are in addition to any required code provisions identified in this report or issued by the Development Review Committee. Conditions approval provided below are within the purview of the DRB. Additional conditions of approval and code corrections are required and will be included with the final report provided to the Director of Community Development. Recommended Conditions of Approval: 1. The applicant is advised that unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. 2. Collectively this information is the record of the review. The analysis in this report is a summary of the completed review. The analysis indicates that with the site access improvements proposed as a part of this development, and the ongoing reconstruction of North Rouse Avenue that the operations of the safety center would not measurably impact operations at the intersections of Tamarack and Rouse, Oak and Rouse, North Peach and Rouse Avenue, and North 7th Avenue and West Tamarack Street in either the peak am or pm hours of operation. The Montana Department of Transportation is currently reconstructing North Rouse Avenue from East Main Street to East Oak Street. No additional offsite improvements are identified. 4 vehicular access locations are proposed and approved by the Development Review Committee and City Engineer. Access deviations have been granted by the City Engineer for access locations to the development. The Montana Department of Transportation, which has jurisdiction over North Rouse Avenue as a state highway is reviewing all accesses from that street.
