MEMORANDUM OF UNDERSTANDING
between
MONTANA STATE UNIVERSITY and CITY OF BOZEMAN
for Collaborative Coursework Projects through the
Community-Engaged and Transformational Scholarship (CATS) Program
This Memorandum of Understanding for collaborative coursework projects ("MOU") is by
and between the City of Bozeman ("City") and Montana State University("MSU"); each entity
referred to as a "Party" to this MOU, and together these entities are referred to as the
"Parties,"
WHEREAS the City and MSU have enjoyed a long history of collaboration and partnership
serving the community; and {
WHEREAS the City and MSU desire to collaborate on various coursework projects
("Projects") by teaming City staff and MSU students and faculty from multiple academic
disciplines using the Epic-N model; and I
WHEREAS the City intends to dedicate staff time and resources for the Projects, subject to
budget approval by the City Commission, and MSU intends to create opportunities for its ,
students to participate and earn university credit; and
WHEREAS this MOU outlines the roles, responsibilities and cost-share of the Parties, and is g
intended to be flexible and may be amended from time to time as necessary and agreed to by
the Parties.
NOW THEREFORE THE PARTIES AGREE AS FOLLOWS.,
1. Term. This MOU will commence on the date last signed, and will terminate on June 30,
2021. The term may be extended for additional two-year terms by mutual written
agreement of the Parties.
2. Project Memoranda of Collaboration ("MOC"). Each Project will be described an a l
separate Project MOC, signed by the Parties, a template of which is attached hereto as
Exhibit A. Each Project MOC will describe the specific services to be performed by and

responsibilities of the Parties for that Project, including:
• Description and purpose of the Project;
• Identified Project objectives and deliverables;
• Timeline and major milestones;
• Specific responsibilities of the City and MSU;
• Project costs and allocation;
• City and MSU Project-specific contact information;
• Any additional terms the Parties agree to include for the specific Project.
In the event of a conflict between an MOC and this MOU, the terms in the MOC will control.
The MOC(s) will be incorporated herein and subject to the terms of this MOU.
3. Modification. Modifications to this MOU will be made by mutual consent of the Parties in
writing, signed and dated by each.
4. Termination. Either Party may terminate this MOU at any time by providing written notice
to the other Party.
5. Ownership of Deliverables. Each party shall retain ownership of its own work product.
Each party hereby grants to the other parties a non-exclusive, royalty free, worldwide
perpetual license to use, copy, and distribute any work product and information provided
that party pursuant to this MOU for any lawful purpose.

6. Advertising. Either Party may advertise or share information concerning the Projects in any

form and with any media without the consent of the other Party.

7. Relationship of the Parties. The Parties agree MSU's faculty, students, agents, employees,
and consultants performing the tasks described in MOCs are not to be considered
employees of the City for workers compensation or any other purpose, and are not subject
to the terms and provisions of the City's employee handbook. The City acknowledges and

agrees that the projects will be performed by enrolled students under the supervision of
faculty for academic credit. The students are not professionals and MSU makes no
representation that the services provided under particular MOCs are professional services
provided by independent contractors. The projects are undertaken to provide students
practical experience as part of the graduate or undergraduate educational experience.
8. Indemnification. Each party hereto agrees to be responsible and assume liability for its
own wrongful or negligent acts or omissions, or those of its officers, agents or employees to
the full extent required by law.
9. Insurance. The City will maintain insurance coverage for personal injury and property
damage suffered by City's officials, employees, and agents arising out of or related to this
MOU. Montana State University, as a state agency, warrants and represents that it is self-
funded for liability insurance, both public and property, with such protection being limited to
the officers, employees, servants and agents of Montana State University while acting within
the scope of their employment. The parties further agree that nothing contained herein shall
be construed or interpreted as (1) denying to either party any remedy or defense available to
such party under the laws of the State of Montana; (2) the consent of the State of Montana
or its agents and agencies to be sued; or (3) a waiver of sovereign immunity of the State of
Montana beyond the waiver provided in Title 2, Ch. 9, Montana Codes Annotated.
J.O. Nondiscrimination. The Parties agree that all hiring of persons performing under this MOU
will be on the basis of merit and qualifications. The Parties will have a policy to provide
equal employment opportunity in accordance with all applicable state and federal anti-
discrimination laws, regulations, and contracts. The Parties will not refuse employment to a
person, bar a person from employment, or discriminate against a person in compensation
or in a term, condition, or privilege of employment because of race, color, religion, creed,
political ideas, sex, age, marital status, national origin, actual or perceived sexual j
orientation, gender identity, physical or mental disability, except when the reasonable
demands of the position require an age, physical or mental disability, marital status or sex
distinction. The Parties will require these nondiscrimination terms of contractors providing
services under this MOU. ;
11. No Joint Venture. Nothing contained in this MOU shall be construed to create any ;
partnership or agency relationship between the Parties for any purpose, action, or

transaction, including those related to this MOU. This MOU does not create a joint venture
or any form of separate legal entity
12. No Third Party Beneficiary. This Agreement is for the exclusive benefit of the Parties, does
not constitute a third-party beneficiary agreement, and may not be relied upon or enforced
by a third party.
13.Appropriation. The Parties agree that City funding for the Projects is subject to budget
approval by the City Commission and the City does not guarantee availability of funding for
Projects in any fiscal year.

Documenting Environmental Health Issues for Students in Off-campus Housing
Pursuant to the Memorandum of Understanding for collaborative coursework projects ("MOU")
between the City of Bozeman ("City") and Montana State University ("MSU") effective
September 1, 2019, the Parties agree as follows:
1. COURSE. 1.310M 21ORN: Principles of Environmental Health Science—and follow-on
spring semester 2 independent study/internship credits.

3. PROJECT PURPOSE AND OBJECTIVES.
The tight housing market and the widespread lack of adequate literacy about
environmental health issues associated with housing and with independent living, put
students at potential risk from environmental health hazards. The Dean of Students, Dr.
Matt Caires, is unaware of any University which is addressing this through student
education or other means, so there are no readily available materials for MSU to adopt.
The goal for this course project is to research and document a variety of environmental
health issues related to off-campus housing (e.g. radon, lead paint, well water safety,
asbestos, etc.) and recommended responses The material will be compiled for
incorporation as sections or chapters in the university handbook on off-campus living
that the Dean of Students office has put together as a reference. The information will
also be presented during Rentapalooza, a campus event focusing on off campus living
considerations for students. Students will also present to community stakeholders such
as County Health Department officials, City staff, City Commissioners, the Good
Neighbor Committee, etc.
In addition, students involved in the course project will develop and submit
environmental health related questions for distribution through a planned campus
survey on off-campus renting and independent student living issues.
Project continuation is planned for the spring 2020 semester utilizing either
independent study or internship credits. Students involved in the spring work will assist
with survey analysis and presentation and compilation of student research materials
from the Fall semester into a single unified product for use by the Dean of Students and
City of Bozeman to educate students and community members.
4. FINAL DELIVERABLES/WORK PRODUCT.
• Campus survey data analysis and report
• Compilation and integration of additional sections/chapters into the Dean of
Students' off-campus living handbook and social media and web content.
• Present research and outcome data to community stakeholders
5. ROLES AND RESPONSIBILITIES.
The City agrees to:
• Provide feedback on project satisfaction through completion of program evaluation
surveys and narrative input.
• Provide data and documentation of previous work products (e.g., program
documents, reports, market studies, plans and maps) that may be related to the
memorandum of collaboration
• Convene team of City staff to facilitate project development and provision of
technical assistance.
• Offer technical assistance, as requested

College Street between 8t" and 111" is a busy thoroughfare with heavy student and
bike/pedestrian usage. Students will explore various traffic calming designs for the street based
on input from neighboring businesses and students and propose various design options to the
City,taking into consideration input from primary users, especially students.
4. FINAL DELIVERABLES/WORK PRODUCT.
Students will develop a final report that outlines their stakeholder engagement and design
process, and which provides an overview of different design ideations for the College
streetscape, including analysis of pros and cons for each.

3. PROJECT PURPOSE AND OBJECTIVES.
The City of Bozeman plans to develop an Urban Design Manual interactive website. The
manual is meant to be an easy and graphically pleasing explanation of Bozeman's form-
based codes. Students will assist in this process by populating a 2-page template provided
by the City on a selected code of their choosing, which will concisely describe: 1)the
purpose/intent of the code and how it may influence social, environmental and/or
economic goals; 2) code requirements; 3) how the code fits with Bozeman's Community or
Strategic Plans; and 4) code departures. Students will include images and sources. The
information and images can then be used by the City in the development of an Urban
Design Manual and website.

Stormwater Pipe Rehabilitation Feasibility Study

3. PROJECT PURPOSE AND OBJECTIVES.
• The project will engage students in providing technical guidance and feasibility
analysis for alternative pipe rehabilitation strategies to inform two unique projects:
1) the downtown trunk line rehabilitation project, to extend the lifecycle of a 100+
year old 36" vitrified clay tile pipe and two concrete manhole structures; and 2) the
South Wilson Avenue pipe rehabilitation project to extend lifecycle of 3,500' of 100+
year old 6" to 12" vitrified clay pipe. Both projects require an analysis of suitable
rehabilitation options to extend the system's lifecycle by 50-75 years with minimal
disturbance to adjacent properties, utilities and roads.
4. FINAL DELIVERABLES/WORK PRODUCT.
• Compiled written report, presentation, and illustrative materials of research findings
and analysis., The report will provide an analysis of suitable rehabilitation options or
project alternatives, including the benefits/negatives-and cost estimate(per foot) for
each option.
5. ROLES AND RESPONSIBILITIES.

month of end of semester.
• Communicate any issues or concerns regarding Project to City staff.

on January 15, 2020.
• Student presentations of preliminary drafts and City review on or about February 24.
• Student presentations of final draft findings and City review on or about April 6.

• Final report compiled by MSU with input from the City will be submitted by
06/15/2020.
7. BUDGET AND PAYMENT. City of Bozeman may provide an amount not to exceed $1000
for project support.

Decentralized Stormwater Facilities Assessment Tool and Implementation Plan

3. PROJECT PURPOSE AND OBJECTIVES.
• The City of Bozeman is seeking to improve its condition assessment efforts of
privately or HOA-owned engineered stormwater facilities through the development
of a data-driven inspection tool to quantitatively assess the current status of
facilities and determine maintenance needs. The project will engage students in
developing a quantitative condition assessment protocol and rating system. The
protocol will be tested on numerous Cattail Creek Stormwater Facilities. Students
will develop HOA deliverables and a plan for implementation of the protocol.
4. FINAL DELIVERABLES/WORK PRODUCT.
• Compiled written report and presentation that will outline the quantitative
assessment protocol and rating system and incorporate a protocol implementation
plan for the City.'

3. PROJECT PURPOSE AND OBJECTIVES.
The City of Bozeman faces a significant challenge every winter in keeping city roads clear
of snow and ice. When a significant snow event occurs,the city's 8 plow trucks will start
plowing as early as 3:00 a.m,to clear the high priority streets, ideally by 7.00 a.m.before
morning traffic gets busy. Depending on the nature of the snow event,they may continue
plowing throughout the day. Over the years,as the city has grown,so has the amount of
snow plowing. Routes have been added and expanded to meet the growth. But currently,
the Bozeman Street Department is not sure that the routes in use are optimal. Thus the
first priority for this project is to develop optimized snow plow routes for the priority snow
removal streets(see:https://www.bozeman.net/government/streets/snow-plowing). The
City is interested in optimized routes for the 8 plow trucks they currently own,with a goal
of clearing all priority streets in 3-4 hours when a major snow event occurs.A simulation
model that incorporates the variability of different snow amounts,traffic congestion,and
other uncertainties would be beneficial for estimating how well the recommended routes
meet the goal and for resource planning.A second priority for this project is to similarly
optimize routes for residential city roads.
4. FINAL DELIVERABLES/WORK PRODUCT.
To fulfill the objectives of the project the following items will be delivered to the client by the
end of the project:
• Routes for the client's current set of plows in a GIS-compatible format
• Analytical justification for any changes to current routes
• Final report documenting methods used to develop routes,and detailing findings on
the feasibility of GPS navigation and HUD's

MSU film students are developing visual media to improve fire and accident prevention
tools to improve awareness among Bozeman community members. Students will work
with the Bozeman Fire Department to capture recognizable local footage to create short
films and social media images that can be used on City and MSU social media channels.
Local images will resonate with consumers, increasing the likelihood they will apply
safety knowledge to their own lives.

• Short film dips and still images to be used for public outreach and education on fire
safety.

The City Parking Program wants to prototype a fine reduction for community service program,
possibly similar to the CAPP pLqgrarn in Los An tiles, In the parking district nearest to the MSU
campus. A CAPP-like program has the potential to positively impact the members of the
community for whom payment of parking fines is a heavy financial burden. A second goal for
the project would be to Improve the relationship between residents of the neighborhood and
commuters. Success of the program will depend on buy-in from key stakeholder groups.
4. FINAL DELIVERABLES/WORK PRODUCT.
Students will develop a final report that outlines their stakeholder engagement, data collection,
and design process, and which provides an overview of different ideas for implementation of a
community-service-for-parking fines program in the MSU parking district, including analysis of
pros and cons for each. In addition, If possible, a pilot period for the most feasible of those
ideas suggested should be conducted in concert with the city. Results from this pilot, if
conducted, should be summarized and included in the final report,

College Street between 81h and 111h is a busy thoroughfare with heavy student and
bike/pedestrian usage. Students will explore various traffic calming designs for the street based
on input from neighboring businesses and students and propose various design options to the
City, taking into consideration input from primary users, especially students.
4. FINAL DELIVERABLES/WORK PRODUCT.
Students will develop a final report that outlines their stakeholder engagement, data collection,
and design process, and which provides an overview of different design ideations for the
College streetscape, including analysis of pros and cons for each. In addition, if possible with
approval from the City of Bozeman, a 1-3 day pop-up project with data collection will be
completed in the spring. Materials for the project will be available from the City of Bozeman's
pop-up project trailer.
