MEETING DATE: February 10th , 2020 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve and authorize City Manager to sign Amendment No. 2 with HDR Engineering. BACKGROUND: Attached is a copy of the partially executed Amendment No. 2 with HDR Engineering for the Davis Lane Lift Station and Norton Sewer Project. The document is in the City’s standard format. During the course of the design completed to date, there have been a number of items that came up that were not included in the original scope. The largest of the items was that the Baxter Meadow homeowners association was unwilling to provide an easement for the sewer main to be installed in the open space between Kimberwicke and Equestrian. This required a complete redesign of the sewer main in this area including all of the required additional field work. There were also some redesign required for the connections of the utilities to the Nelson subdivision, adding fiber to the I-90 and rail crossing, and adding dewatering requirements associated with the solvent site plume. This amendment covers the compensation for these additional items. UNRESOLVED ISSUES: None ALTERNATIVES: As suggested by the City Commission FISCAL EFFECTS: $61,300.00 from the Wastewater Impact Fee Fund. Attachments: Amendment No.2 Report compiled on: 1/30/20 61 » y v 0 ?^ .< 7<^s^@ss'^ s^ « SECOND AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT THIS SECOND AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT FOR Davis Lane Lift Station and Norton Sewer Project dated February 25, 2019 (the "Agreement") is made and entered into this _ day of' , 2020, by and between the CITY OF BOZEMAN, MONTANA, a self governing municipal corporation organized and existing under its Charter and the laws of the State of Montana, 121 North Rouse Street, Bozeman, Montana, with a mailing address ofPO Box 1230, Bozeman, MT 59771, hereinafter referred to as "City," HDR Engineering, Inc., hereinafter referred to as "Contractor." " In consideration of the mutual covenants and agreements herein contained, the receipt and sufficiency whereof being hereby acknowledged, the parties hereto agree to amend the Agreement as follows: 1. Scope of Services. Section 2 of the Agreement is revised to include the attached Exhibit A. 2. Payment. Section 4 of the Agreement is revised to include the amount specified in the attached Exhibit B. The additional design services are to be lump sum. Original Fee: $ 841,714.00 Amendment 01: $ 39,834.00 Amendment 02: $ 61.300.00 Total: $ 942,848.00 3. Agreement still valid. Project Management Objective: Manage the constmction administration contract and prepare monthly invoices. Subtasks: 101 Project MEanagement and Invoicing. Manage subcontracts and construction administration tasks. Prepare monthly invoices for submittal to the City of Bozeman. Task 400. Final Design Revisions Objective: Complete design of alternate sewer route in Arabian Avenue in lieu of the Baxter Meadows HOA sewer route and shift sewer alignment east of the Maynard Border Ditch through the City Park from Baxter Lane to Equestrian Lane. Also includes miscellaneous design revisions not included in the original scope of work. Subtasks: 412 Misc. Final Design Revisions (Fiber, Nelson Sub, GW Plume) Revise final plans to include items not in the original project scope of work, including: adding fiber optic conduit and associated appurtenances at the 1-90 crossing and forcemain route; update plans to include connections to the water main and sewer forcemain for the Nelson Meadows Subdivision; address groundwater dewatering associated with the solvent plume; and prepare deviations and coordinate with DEQ on permitting to include the water and sewer main in a single casing at the 1-90 crossing and setbacks from wells along the project corridor. 413 Review As-builts and Existing Information for Arabian Route. The existing as-built drawings for the Arabian Avenue sewer route include the Baxter Meadows Subdivision Phase 3 record drawings from 2007. These record drawings will be reviewed with respect to the existing sewer and water main depth in Equestrian Lane, Arabian Avenue, Kimberwicke Street, and the existing water and sewer service locations in Arabian Avenue. Other existing information includes private utility maps, aerial imagery, and the City ofBozeman GIS mapping. 414 Topographic Surrey, Control, & Locates for Arabian Route. The existing control network will be expanded to include the Arabian route and a limited search for property comers along the east side of Arabian Avenue will 1 of 3 64 done to update the existing base drawing sheets and show the existing lots along Arabian Avenue. The topographic survey limits will be an average of 60 feet wide and extend from the original Norton sewer route located on the south side of Equestrian Lane on the west side of the Maynard Border Ditch, then northeast to the intersection of Equestrian Lane and Arabian Avenue, then north in Arabian Avenue to the north side ofKimberwicke Street, and then west approximately 100 feet to the original Norton sewer route. Additional survey will also be completed for the revised route through the City Park on the east side of the Maynard Border Ditch from Baxter Lane to Equestrian Lane. Utility locates will be requested for the Arabian route and survey measure downs will be conducted on existing water valves and sewer manholes along the Arabian route. The existing survey base map will be updated based on the additional topographic survey. 415 Prepare Plan and Profile of Arabian Route for City and DEQ Review. Design sewer alignment and depth in Arabian Avenue based on following the existing sewer alignment in Arabian Avenue at a depth necessary to reconnect the existing sewer services into the new 27-inch sewer main and cross under the existing water services. It is assumed that the revised sewer main route will connect back into the original Norton sewer design at Baxter Lane and north of Kimberwicke Street without redesigning the sewer main upstream or downstream of these tie-in locations. Prepare plan and profile drawings of the Arabian route for the City ofBozeman and DEQ review. 416 Prepare Opinion of Probable Cost for Arabian Route. Provide Engineer's Opinion of Probable Cost for the Arabian sewer route. 417 Quality Control Review for Arabian Route. Provide quality control review of the Arabian sewer route. 418 Finalize Plans and Specs Based on City/DEQ Comments for Arabian Route. Address City and DEQ review comments and produce final plans and specifications for the Arabian sewer route. Update the original specifications and bid form to incorporate the Arabian sewer route. 419 Update Wetland Permitting Applications for Arabian Route Update the Joint Application permit to reflect new wetland impacts. Perform desktop wetland delineation of new impacted area. Provide functional assessment of the covenant wetland using MDT WMAM method. Coordinate mitigation credits and develop wetland mitigation memo. Items Not Included: The following items are not expected to be needed for this project and are therefore specifically excluded from this scope of work: 2 of 3 65 Preparation of separate bidding packages if the City decides to split the project into two or more separate projects.
