COMMISSION RESOLUTION NO. 3955
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
STATING THE CITY'S INTENT TO REVISE THE BOZEMAN 2020 COMMUNITY PLAN BY
AMENDING THE LAND USE DESIGNATION, AS SHOWN ON THE FUTURE LAND USE
MAP, FROM "FUTURE URBAN" TO "RESIDENTIAL" FOR 138 ACRES, WHICH IS
DESCRIBED AS TRACT 2, CERTIFICATE OF SURVEY NO. 2177, ACCORDING TO THE
PLAT THEREOF, ON FILE AND OF RECORD IN THE OFFICE OF THE CLERK AND
RECORDER, GALLATIN COUNTY, MONTANA, AND BEING A PORTION OF THE
NORTHEAST QUARTER OF SECTION 26, TOWNSHIP 2 SOUTH, RANGE 5 EAST OF
P.M.M., AND FURTHER DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHEAST CORNER OF SAID SECTION 26; THENCE
WESTERLY 269052'52", ASSUMED AZIMUTH FROM NORTH 49.72 FEET ALONG THE
NORTH LINE OF SAID NORTHEAST QUARTER TO THE POINT OF BEGINNING OF THE
PROPERTY TO BE DESCRIBED; THENCE SOUTHERLY 179050'17" AZIMUTH 1329.74
FEET ALONG THE WESTERLY RIGHT OF WAY LINE OF SOUTH 19TH AVENUE;
THENCE WESTERLY 269054'37" AZIMUTH 654.99 FEET ALONG THE NORTH LINE OF
TRACT 1, CERTIFICATE OF SURVEY NO. 2177; THENCE SOUTHERLY 179056'22"
AZIMUTH 1329.41 FEET ALONG WEST LINE OF SAID TRACT 1; THENCE WESTERLY
269056'22" AZIMUTH 1946.02 FEET ALONG THE SOUTH LINE OF SAID NORTHEAST
QUARTER; THENCE NORTHERLY 359057'09" AZIMUTH 2656.83 FEET ALONG THE
WEST LINE OF SAID NORTHEAST QUARTER; THENCE EASTERLY 089052'52" AZIMUTH
2598.05 FEET ALONG THE NORTH LINE OF SAID NORTHEAST QUARTER TO THE
POINT OF BEGINNING.
WHEREAS, Planning staff has processed an application for a Growth Policy Amendment to
amend the Bozeman 2020 Community Plan for 138 acres lYIng west of South 19th Avenue and
located at 4999 South 19th Avenue; and
WHEREAS, the application for a Growth Policy Amendment would amend the land use
designation, as shown on the Future Land Use Map, from "Future Urban" to "Residential" for all
138 acres; and
WHEREAS, the Planning staff assessed the application in light of the criteria set forth for
review of Growth Policy Amendments contained in the Bozeman 2020 Community Plan; and
WHEREAS, the City of Bozeman Planning Board conducted a public hearing on an
application for said amendment at its regular meeting held on August 15, 2006, taking into careful

consideration the criteria set forth for review of Growth Policy Amendment applications; and
WHEREAS, a majority of the membership of the City of Bozeman Planning Board was able
to find that the application complies with the approval criteria established in Section 2.4.1 of the
Bozeman 2020 Community Plan, and that the proposed amendment would constitute an overall
improvement to the Plan; and
WHEREAS, subsequent to its public hearing, with of vote of 4 in favor and 2 against, to
forward a recommendation to the Bozeman City Commission that the application to change the
land use designations be approved; the Planning Board did not have the affirmative vote of five
members as required for a formal recommendation,
WHEREAS, the City Commission is scheduled to conduct its public hearing on said
amendment at its regular meeting to be held on September 5, 2006, to consider the applicant's
request to amend the Bozeman 2020 Community Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that it intends to revise the Bozeman 2020 Community Plan by amending the land use
designation, as shown on the Future Land Use Map, from "Future Urban" to "Residential" for
approximately 138 acres, on property located at 4999 South 19th Avenue and legally described as
Tract 2, Certificate of Survey No. 2177, according to the plat thereof, on file and of record in the
office of the Clerk and Recorder, Gallatin County, Montana, and being a portion of the Northeast
Quarter of Section 26, Township 2 South, Range 5 East of P.M.M.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
