The City Commission shall have no power to deny the proposed use but shall act only to allow a public forum for comment on the proposed use per MCA 76-2-402. BACKGROUND: The new Bozeman School District high school on the west side of the city is named Gallatin High School. The site plan to approve the construction of the school was approved in May 2018 as the New Bozeman High School Site Plan, Application 18085. A modification to that plan has been submitted that proposes prohibited signs. The District is claiming agency exemptions from compliance with certain zoning standards under Montana Code Annotated (M.C.A.) Section 76-2-402. The development proposed does not meet municipal zoning standards for prohibited signs required as described in the Unified Development Code, Article 38 of the Bozeman Municipal Code. Montana law (M.C.A. Section 76-2-402) addresses the relationship of municipal zoning regulations to a school district’s use of land. The law requires a public hearing whenever land is to be used contrary to zoning regulations. The statute expressly provides that a municipality “shall have no power to deny the proposed use but shall act only to allow a public forum for comment on the proposed use.” The requirement for a public hearing before the City Commission on such exemptions was specifically included in the 2012 Interlocal Agreement executed between the School District and the City of Bozeman. The School District is claiming exemptions to the Bozeman Municipal Code provisions for two new signs, with the provided rationale as follows: Scoreboard-Competition Sport Field: The new scoreboard design includes video playback and the overall dimensions are 33’-6” high by 25’-0” wide, with the video display area being 224.7 square Landscaping, including wide berms and evergreen trees within the buffer area surrounding the school site provide visual relief and screening of the athletic fields and scoreboard. The scoreboard will be located within the property boundaries and is not legible when viewed from outside the property boundaries. A photometric electrical site plan is being provided as part of this application as well as street image views of the scoreboard from Annie Street, Durston, and Flanders Mill. 185 Commission Memorandum Readerboard: The new reader board design will be located within the property boundaries and will be used for internal student and parent messaging. The reader board will be 5’-0” high by 8”-0” wide, with the overall display area being 27.1 square feet. The readerboard is not legible outside of the property boundaries. For these reasons, an exemption of Section 38.560.030 A5 is being pursued to allow for an animated scoreboard and readerboard with LED display and electronic messaging. No public comment letters have been received. The decision on the modification application is under the authority of the Director of Community Development. Following the exemption hearing staff will finalize the review of the modification application and forward on a recommendation for a Director decision. The City Commission is not the authority for the modification application, but is the venue for any exemption claims hearings submitted per the M.C.A. UNRESOLVED ISSUES: None. ALTERNATIVES: 1. The City Commission receives the Gallatin High School scoreboard and message sign modification application and conducts a public hearing on the agency exemptions the Bozeman School District 7 is claiming under Montana Code Annotated (M.C.A.) The property north of Annie Street (Tract 1A2) will contain the new high school building, associated parking lots/access drives, two practice fields, and tennis courts. The property to the south of Annie Street (Tract 2A) is Meadowlark Elementary School (approximately a 10-acre campus). In addition, a competition track complex, softball fields, and comfort station will be located south of Annie Street. Development of this site will be completed in a single phase starting in the spring of 2018 and being ready for occupancy in the fall of 2020. The design population of the proposed high school is 1,500 students. The site south of Annie Street consists of 3 practice fields, 2 softball fields, a competition multiple sport field, field events such as shot put, javelin, and discus, jumping events such as the high jump, pole vault, and long jump, a completion level track with 10 lanes, and 8 tennis courts. The competition area will include bleachers, scoreboard, storage facility, and a comfort station. The area is linked to Meadowlark Elementary School via an asphalt trail. A modification application is being submitted to include a new scoreboard design for the competition sport field, as well as a readerboard to be located north of Annie Street near the main entrance.
