with Architecture 118, LLC for the Stiff Building Remodel Phase

RECOMMENDATION: Authorize the City Manager to sign the first addendum for
Professional Architectural Services Agreement with Architecture 118, LLC for additional
construction administration services for the Stiff Building Remodel Phase 2.
BACKGROUND:
On June 17, 2019 the City Commission authorized the City Manager to sign a Professional
Architectural Services Agreement with Architecture 118 for design and contract administration
services for phase 2 of the Stiff Building Remodel project.
Significant efforts made during the design phase to appropriately balance the centralization of
customer service, accommodation of future staffing needs, and improvements to safety
resulted in a shortage of contract hours required to adequately perform construction
administration services. This addendum will compensate Architecture 118, LLC for services
needed to complete the project on schedule with a high level of quality.
UNRESOLVED ISSUES:
None.
FISCAL EFFECTS:
On January 13, 2020 the City Commission adopted Resolution No. 5123 amending the City’s
annual budget for FY20 to allocate funds sufficient to complete the project. Fees associated with
additional construction administration services total $10,000. Adequate funding exists within the
total project budget of $1,264,725.

FIRST AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT
THIS FIRST AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT FOR
PROFESSIONAL ARCHITECTURAL SERVICES AGREEMENT dated June 3, 2019 (the
“Agreement”) is made and entered into this _____ day of ____________, 2020, by and between
the CITY OF BOZEMAN, MONTANA, a self governing municipal corporation organized and
existing under its Charter and the laws of the State of Montana, 121 North Rouse Street, Bozeman,
Montana, with a mailing address of PO Box 1230, Bozeman, MT 59771, hereinafter referred to as
“City,” Architecture 118, LLC, hereinafter referred to as “Contractor.”
In consideration of the mutual covenants and agreements herein contained, the receipt and
sufficiency whereof being hereby acknowledged, the parties hereto agree to amend the Agreement
as follows:
1. Scope of Work. Eighty four (84) hours of additional construction administration services.
2. Payment. The City agrees to an additional charge of $10,000 for work performed by
Architect in accordance with this Addendum
3. Agreement still valid. All remaining terms and provisions of the Agreement remain valid.
