HomeMy WebLinkAboutResolution 3944 Place the Question of adopting the LSGS recomendations on the ballot COMMISSION RESOLUTION NO. 3944 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, STATING THE COMMISSION'S INTENT TO PLACE THE QUESTION OF ADOPTING THE CHARTER CONTAINED IN THE FINAL REPORT OF THE LOCAL GOVERNMENT STUDY COMMISSION ON THE NOVEMBER 7, 2006, BALLOT. WHEREAS, Section 7-3-173, Montana Code Annotated, provides for electors to vote on the question of conducting a local government review and establishing a study commission every ten years; and WHEREAS, at the June 2004 primary election, the voters approved for formation of a study commission, the purpose of which was to study the existing form and powers of a local government and procedures for delivery of local government services and compare them with other forms available under the laws of the state, as established by Section 7-3-172, Montana Code Annotated; and WHEREAS, at the November 2004 general election, the voters elected five people to serve on the Local Government Study Commission; and WHEREAS, the Local Government Study Commission has completed its study of the existing form and powers and identified the need for a charter; and WHEREAS, the final report of the Local Government Study Commission and the proposed charter, were adopted by the Study Commission on August 8, 2006. WHEREAS, the Election Administrator requires that the proposed ballot issues be adopted by resolution of the Local Governing Body. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that Section 1 The following ballot issue of the Bozeman's Study Commission be placed on the November 7,2006, general election ballot: "BALLOT ON THE ALTERNATIVE FORM OF LOCAL GOVERNMENT Vote for One. D For adoption of the self-government Charter with the city manager plan of government proposed for the City of Bozeman by its Local Government Study Commission. D For the existing form of government." Section 2 The following ballot issue of the Bozeman's Study Commission's sub-option also be placed on the November 7,2006, general election ballot: "CHARTER SUB-OPTION ONE Vote for One. Beginning in the year 2007, the Mayor of the City of Bozeman D Shall be the city commission candidate who receives the highest number of votes in the city general election. D Shall be directly elected by the voters." PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the ~ day of Auaust 2006.
