MEETING DATE: January 13, 2020 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the Mayor to Sign Resolution 5128 Authorizing Change Order Number 1 to the Sunset Hills Cemetery and Lindley Park Water Conservation Project. BACKGROUND: The Sunset Hills Cemetery and Lindley Park Water Conservation Project included the installation of infrastructure necessary to utilize existing surface water supplies in Bozeman Creek to irrigate Sunset Hills Cemetery and Lindley Park. Benefits of this project include the conservation of treated drinking water supplies, increased instream flows in Bozeman Creek, and year-round fish passage in Bozeman Creek. Attached is Resolution 5128 and Change Order No. 1 for the above referenced project. The change order modifies the construction contract by decreasing the total contract price by $10,988.00 and extending the final completion date to December 31, 2019. The purpose of the price modification is to reconcile the final contract price to the original contract amount based on actual quantities. Lower quantities than originally estimated for a number of bid items were required, resulting in a final contract price of $610,155 as compared to the original contract amount of $621,143. The extension of the final completion date was needed to accommodate unforeseen scheduling issues regarding power connection, to allow for proper project closeout, and to meet grant reporting requirements for the Bureau of Reclamation and Department of Natural Resources and Conservation. The substantial completion date for this project did not change and the contractor met this deadline. FISCAL EFFECTS: The FY20 general fund CIP includes project GF231 – Cemetery Irrigation Project, which is allocated $682,859. Of the $682,859 allocated for this project, Bureau of Reclamation WaterSMART Water Efficiency Grant funding reimbursement represents $300,000, Department of Natural Resources and Conservation Renewable Resource Grant funding reimbursement represents $125,000, and the City of Bozeman general fund represents the remaining $257,859. The final contract price for construction of this project is $610,155, a reduction of $10,988 in total costs. UNRESOLVED ISSUES: None. WHEREAS, The City Commission did, on March 4, 2019, authorize award of the bid for the Sunset Hills Cemetery and Lindley Park Water Conservation Project to Central Excavation Inc., Belgrade, Montana; and WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or modifications of the specifications and/or plans of the contract be made by resolution; and WHEREAS, it has become necessary in the prosecution of the work to make alterations or modifications to the specifications and/or plans of the contract. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a municipal corporation, and Central Excavation, Inc., as contained in Change Order No. 1, attached hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to execute the contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest such signature.
