PUBLIC STREET AND UTII~ITY EASEMENT
BEMBRICK STREET AND ENEBOE A VENUE
BLACKLEAF GROUP, LLC, with a mailing address of321 East Main Street, Suite 208, Bozeman, MT
59715-4731, the GRANTOR, in consideration of One Dollar ($1.00) and other good and valuable
consideration, receipt of which is hereby acknowledged, grant(s)to the CityofBozeman, a municipal
corporation ofthe State of Mont ana, with offices at 411 East Main, P, 0, Box 1230, Bozeman, Montana
59771-1230, the GRANTEE, its successors and assigns, a perpetual street and utility easement for the use
ofthe public, over, under, and across, a strip ofland situated in Gallatin County, Montana, 30,00 feet wide
to be located on the following described real property:
Tract 1, Certificate of Survey No, 985, according to the plat thereof, on file and of record in the office
ofthe Clerk and Recorder, Gallatin County, Montana, and located in the NW 1/4 of Sec. 10, T. 2 S.,
R. 5 E. ofP.M.M..
The easement is more particularly shown and described on the attached Exhibit C, which by this reference
is made a part hereof.
The GRANTOR states that it possesses the real property described above and that it has a lawful right to
grant an easement thereon,
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges
herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding upon the heirs,
executors, administrators, personal representatives, successors, and assigns ofthc parties hereto,
